Ebay item not rec'd - where to take the claim

Hi

My partner won a game on ebay a while ago and it still hasn't turned up.

We paid by paypal but it's not worth going through ebay or paypal as their 'recovery fees' mean that we won't get anything back as the item in total only cost £20.

Any idea what to do now? It's only £20 but still. Could we use the Moneyclaim website for this and what happens if the seller sends the game - we would be £30 out of pocket for the moneyclaim fees.

Any help gratefully received!

  • Welcome to MSE :)

How long ago did your partner win the game?

You can start a PayPal dispute. As far as I know that won't cost you anything. If you go through eBay it will cost you £15 (I think).

Thanks for the welcome and the response.

It was about 10 days ago - I just get the feeling that the buyer wanted more for the game than it was sold for so won't send it!

You still pay a fee on paypal if the item is not received. Again it around £15 - so wouldn't be really worth doing!

They say this sometimes on the small print... but it's never happened to me.

if the paypal buyer protection logo was on the listing, you can claim from paypal, with no £15 deduction..

open an item not received dispute in paypal....

I'm not sure the protection thing was on because the seller's feedback was 96% and 98% which I think it has to be - only just learnt this from reading the policy.

For the seller the couple of negative feedback they have had has turned out to be a good thing for them.

    You live and learn.

I have used a few dubious buyers and had to do a few Items Not Recieved, and have never been charged

If you are worried about it, you could contact the seller and say "Do you want me to start a paypal dispute and freeze your account for over 2 months or do you want to send me a refund"

have you contacted the seller about it...opening the dispute may prompt them into doing something...

Opening the dispute will also alert paypal to any pattern of bad trading behaviour.

I'll see if it arrives tomorrow and then send a note in the terms you guys have suggested. Hopefully it will prompt some action.

Thanks for your help - I'll keep you posted!

Look at the auction again,on the right hand side under their username etc.
Check if it says Paypal Buyer protection,up to £500.
If so it will not cost you anything to claim back your Paypal.
10 days is still quite early, try e-mailing/phoning first.
If no luck open a dispute via e-bay,if you paid by Paypal it will direct you to Paypals resolution centre.
    Good Luck!
