I would also have words with the MOT station if the MOT was just done.

They wont want to risk you having the MOT questioned. Especially if the car was done very recently
and as a favour to the dealer.

Many years ago my mate got chatty with the MOT station took a car in and it passed, Sold the car on straight away.

Buyer had the car checked and found a split up the inner wheelarch / bulkhead area. He had only hidden it not repaired
it properly. My mate said tuff sold as seen.

They took it back to the MOT station and they ended up buying the car. My mate couldnt show his face around
    there again.

There are so many issues here, from the issue of an MOT which is clearly a "wrong un", to the fact that the purchaser should be more careful when buying a vehicle. The faults which you have mentioned are very obvious, not only to an expert, but also to anyone who has owned a car before.
I have found two types of car buyer:
Those who are careful and will look around a car and walk away if it is not right.
Those who make their minds up without even seeing a car, and will not back down on their decision, even if the vehicle is a "dog" (my father is unfortunately one of these, and will only consult me once he has bought a car).

If you're going to question the validity of the MOT issued by the testing station then, you will have to report it to VOSA and have it inspected by them very quickly. Remember that an MOT is undertaken on the day of issue and anything that happens after that could mean that a re examination would take place with the car in a different state to that originally tested.

Even driving a car for a week could mean action against the issuing testing station would be impossible unless the faults are significant e.g. corrosion.

This highlights what I was being shot down for saying months ago...... When a garage MOTs a car they intend to sell, you really have to take that MOT certificate as being an entirely meaningless scrap of paper!

If it is sold as a trade sale he will be signing a CONTRACT to say he (buyer) is a vehicle trader and he is getting the vehicle as a trade transfer.
If he is asked to sign a receipt just to say,,, blah blah it ceases to be a receipt at that point and becomes a contract limiting his legal rights.
He will have no recourse if he signs it or has signed it.
You do not sign receipts, ever ! you sign contracts.

OH cousin goes under the shutter to wich the OWNER shouts GET OUT FROM THERE! my OH cousin explains he is purchasing the car and wanted to have another look, BUT THE OWNER REPLIES DUE TO HEALTH AND SAFETY CUSTOMERS ARE NOT ALOWED INTO THE VALETING BAY. alarm bells rang in my head
The garage are perfectly correct. Employees have to go through health and safety induction before being allowed in the workshop area. It is not an area freely accessible to the public.

any way, what would you do here? and what do you think of his sales tactic?
price paid for the car was £1400. refused to take part ex for his 98 corsa.
So its banger money and they quite rightly didn't want to take a completely unsellable 13 year old car in P/X

OK, now I'm going to play devils advocate...
descrepancies i found on paper work!

    1. the sales man gave him the complete V5C to fill in and send off.
    Not of any importance.

what i found looking over the vehicle. bare in mind MOT was done today in the AM.

    1. driverside wiper blade is worn to the point it smears the windcreen to obscure the drivers view.
    Doesn't mean it'd fail.
    2. indicator on driver side flashes irregularly (flasher unit/coms stalk fault)
Might have passed OK, only has to work briefly in the test.
    3. driver side tyre worn on the inner to centre past minimum legal limit.
    Only the center 75% counts.
    4. passenger tyre ON legal limit.
    Still a pass though
    5. exhaust rear silencer excessivly corroded/leaking.
Corrosion is irrelevant. They can still leak slightly and pass a test surprisingly.
    6. headlamp beam high, bulb illfitted no signs of tamper prior to my adjustment.
And you have a headlamp alignment gauge or are you just guessing against a brick wall?
    7. front passenger and drivers brake disc past minimum thickness they are extremely thin and shows signs of cracking.
Are they cracked or aren't they? They cannot "show signs". Either they are or they aren't.

whats your take guys, im sure he should contact vosa, and trading standards about this. he spent nearly £80 on pair of tyres (kept the old ones and has photo's of them on car and tyre inspection reprt reciept).

    Its £1400. Its banger money.

No matter what or where you're buying from or how much you are paying, you should always treat a MOT as a meaningless scrap of paper. It has absolutely no bearing on the relevance of the condition of the car once it has left the test station. Also it only covers a very limited list of checks.

Why people think a MOT is an indication of the condition of a car is beyond me. You could have a car where absolutely none of the electrics other than the lights, horn, wipers and ignition system work and it will pass an MOT. You can have one with an engine that is at the point of grenading and it will pass an MOT if it can get through the emissions check. The clutch could be shot and it'd pass. You can have the entire floor of the boot missing and as long as it wasn't structural or within 30cm of a suspension mounting point it'd pass.

Isn't it just the teensiest bit late to haggle, ask for a(n additional) warranty and pick at the transaction after the deal is done?
