Oh I will be but I normally like to try and get an idea of something first but I must confess I’ve found this one a bit difficult to research online.
I understand that a provision would need to be made for a maintained child but don’t really understand how that provision is made. Whether it’s 15% of the Father’s estate (same amount of CSA liability) or what the Father would have had to pay up until the child reached 19.
Say there was £100,000 in the Fathers estate……
Option 1 would mean £15,000
Option 2 (if liability was £50 per week for a 9 year old) would mean £26,000
As you said all will become clear I’m sure on speaking to a solicitor.
I need to look into this as my hubby has another son who he's never seen but pays CM for (I forgot about him!). Would I have to make a provision for him before splitting the rest or if he died first would I have to make a provision before the money came to me?
I never thought about all this, would his estate include life insurance?0 -

I’m probably as much in the dark as you are but from what I understand all of his biological children would have a claim on his estate (which I believe would include his life insurance).0 -

No and I wouldn't. We have him regularly and as far as I'm concerned any money would be split equally between our five kids (three to my ex, 1 to his ex and 1 of our own) I don't have a will as we have no assets or life insurance at the moment (we can't afford it) If we did I wouldn't treat our child any differently to my ex's kids or his exe's kids. The will would put the money in trust until their 21st birthday though. If he died before his son's 21st and CM had to be paid then it would come out of his trust. (If you could do that)

Oh god, I never even thought of that. I know the kids would be well looked after by their Dads if anything happened to me but the thing that would upset me is if my older three never saw the youngest one, they all love him so much!! Can you make a provision for that in a will?0 -

I'm really not sure, possibly not.
But it might be an idea to find someone who would be willing to look after the youngest if the worst happened (and who you're happy with), and discuss with them and your ex, your wishes. You may be able to get them to agree, and then confirm it in your will.February wins: Theatre tickets0 -

Yes and as callous as it sounds I may need to protect my money from my husband for inheritance purposes. If his children can have a claim to his money I would imagine that without a will his estate would be deemed to be 50% of what we have as a couple.
In reality more money has come from me and whilst I am happy with his children having a share of his money I am not happy for them to have a share to my money.
I therefore need to speak to a solicitor to establish what is the best thing for us to do going forward.0
