O2, again.

I have recently upgraded my phone with O2. They were incompetant from the start and this led to two phones instead of one being delivered to my work. I am currently using the phone intended for me but not the other. O2 are aware that the extra phone was signed for at work.

Does anybody know what consumer rights and responsibilities i have with the additional phone? Am i obliged to send it back or else wait for O2 to collect it? If i am not obliged to send it back, at what point does the ownership become mine?

Any pointers greatly appreciated.

    Personally.. common sense and send it back? Obviously it was a mistake, just make sure you send it recorded/tracked ;)

    I doubt the ownership of the 2nd phone is yours. If you accidentally sent 2 payments instead of 1 you would expect them to refund you right?

    I would think its 02's responsibility to collect it or at minimum offer to pay back the postage cost to send to them as it was their mistake which the cost shouldnt be on you.
  • O2 will either arrange collection of it via DHL, send you a freepost envelope to send it back or request you send it back to them and they refund the postage on your account.

    However if they dont receive the item back or its kept due to thinking that they have forgot about it then expect a large phone bill where they will charge it to.

    it will update on their pod, although I know someone who got 2 lappys out of 3
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    No rights to the handset in the first instance, however it is up to them to pay for the return or provide the means of doing so. If an arrangement has not been made after 12 weeks or so, WRITE to them, saying they have 28 days to arrange collection or you will dispose of that (and keep a copy). After that date, it could be argued you have done all that is reasonable and have good title.
