Help please re faulty perfume :(

    If you are now saying it's logged with Ebay, Someone with better knowledge than me could advise on if its possible to change the type of dispute or leave it as a SNAD.
    If Ebay tells you to return the item to the seller do it by a tracked/recorded method. All may not be lost, may depend on email etc being used as evidence by seller.

    I tried to edit the post where I put paypal as soon as I posted it but for some reason it didn't save. Yes I logged it with ebay. The seller is being quite aggressive in her tone so will just wait it out and see what happens next.

    Sorry, so have you got a dispute open in Paypal or Ebay. If it is Ebay this is better news for you. Ebay don't need you to prove fake, they need the seller to prove it is authentic.

    That's good news!! I will wait for the week to pass then escalate it to Customer Service desk. She is adamant she isn't refunding it. I won't be buying perfume on ebay again, that's for sure.

    One possibility is that it's not fake, but a tester (likely because of the missing top) that has been exposed to heat and light, both of which change perfumes.

    ETA: Ebay UK now forbid the sale of testers, which may be relevant.

    I'll share my own experience with counterfeits :(

    I love Adidas/Nike and unfortunately recently I have had 5 (!) items delivered that were supposed to be the brands above but they were very poor fakes.

    Two sellers refunded immediately, I offered to send back but they said not to worry (all of these are used clothes, I do not buy new as would be too worried about receiving a fake from China, one would think that people are selling clothes they bought from a real shop but my recent experience shows that sometimes people buy off internet not realising the goods is not genuine!).

    For the other items I have had to raise an Ebay dispute (as per the advice from others do not open a SNAD with Paypal when it's a counterfeit unless you have an official document proving it is a fake), one seller did not reply and Ebay refunded me immediately after escalating, two others got in touch apologising they did not realise it was a fake and because I thought they sounded genuine I sent the items back.

    People here seem to think that once you escalate with Ebay for a SNAD for a counterfeit that you won't need to be sending back to the seller, unfortunately I do not know if that's the case. However, I would urge you to write down ALL the relevant details carefully as I would bet this will sway them to find the dispute in your favour (contrary to what some people think I know for sure that Ebay does read the messages carefully - perhaps not all the time but on the odd occassion they do and you might lose the dispute if the other side is arguing better, please do not underestimate this).

    If it was me I would say that you did not realise this was a counterfeit till someone pointed this out to you, you then went to a regular shop, smelt and looked at the item in question carefully and it was totally different to the one you received due to: (now list any relevant details and be as specific as possible, e.g. item received smelt this way but in fact the genuine item smells like this, etc).

    If Ebay did ask you to send back (which I doubt if you are as specific as possible) and you did want to post what you received back to them, why not ask the buyer of the item to post it back to you (I'm sure that if you offer to pay for their postage costs they'll be happy to do that unless they have disposed of the item OR the item is in fact genuine and you have just gotten scammed) and then post it back to the original seller? This woudl mean you'd have to pay twice for the postage costs...but at least you'd get the rest of your money back?

  • The seller is adamant they have not sold a fake and the perfume has lost it's smell as it has no top even though I disputed this.

    She is becoming quite rude and said she hasn't got the time to waste over £15 so will refund me on receipt of the perfume.

    She said she will not refund the original postage as she doesn't normally accept returns.

    I had asked for a full refund including my original postage. Am I right to ask for this?

    If you win the case your seller will have to refund the original p&p.

    If you're in the mood for it, I guess that simply reporting it as a tester will get ebay on your side. They are all forbidden on ebay uk. Does it say (often in barely legible print on the base) Not for Resale, or Vente Interdite (same thing in French)?
