Help please re faulty perfume :(

I recently purchased a bottle of perfume off ebay. When it arrived it smelled differently to how I remembered it and assumed I had bought the wrong one. To save hassle I relisted it and left positive feedback for the seller as I thought it was my error and they had been patient with my payment as the card on my paypal had expired so I paid via echeque which took ages! When the new buyer received it they raised a dispute to say the perfume was in fact a fake. I was shocked as I only sell what goods I would be happy to buy. I refunded them and hoped that I would be able to get a refund too.

I have opened a dispute with the original seller and at first they said that the most they could do was refund the cost of the perfume but not my original postage and now they are refusing to refund me at all. They said that the listing picture showed that there was no top and it is a known fact that perfume changes smell with no top – I didn’t know this and there was no mention of that in the listing. They also said that as I sold it on it has been used hundreds of times and they don’t accept returns anyway. I have inspected the perfume bottle before I refunded my buyer and it looks like it has the exact same amount in the original picture.

The dispute on ebay says that they have a week to respond before I can take it further. Am I able to take it further or is it a lost cause as I left positive feedback and sold it on.

    It's all a bit of a mess, do you think the perfume is fake?
    No top! what stopped the perfume from leaking?
    What sort of top was on it when you received it?
  • I do think the perfume is fake. I have been to Boots and it's a completely different smell. Just wish I had done that before I relisted it.

    It has a spray top on but no lid. The tester bottles at Boots are on show similiar, without a lid.

    You should have raised a dispute with Ebay saying you believed the item is counterfeit in the first place, selling it on was a bit of a No No.
    As things stand what type of dispute have you raised?
  • Perfume doesn't have an infinite shelf life, so it could just be 'off'.

    As a perfume buff I can assure you that a spray bottle does not need a lid to protect the ingredients. This is nonsense and fortunately such complete nonsense that no-one would give it 5 seconds. The lid is not airtight anyway.

    The important question is what category did you raise the dispute under? Significantly not as described? Or that it is a fake?

  • If you have mentioned that it is counterfeit, then Paypal will require you to give written evidence from an authorised reseller that the item you have is fake. You only have 10 days to do this.

    If you have just filed a SNAD, then what have you said in the reason box?
  • I have raised it as not as described and have listed that the item is fake and explained why I think so. I didn't realise I would have to prove it is a fake. Thank you everyone. I have learnt a lesson from this that's for sure :(

    Hope it wasn't an expensive lesson, general opinion on here is to go through Ebay for fake items, where the seller has to prove it's not fake, and you don't have to return the product
    Just see where the Paypal dispute goes, has the seller replied to your comments/claims in the dispute?
  • It has cost me £20 included postage :S

    I have disputed via ebay not Paypal.
