With respect, the fact that you used to work at Argos means you know what you were trained to tell people when you worked there. Your old manager will almost certainly tell you the same thing - that he can't do anything to help.

Sadly, you were wrong when you told people that, and he's wrong now. A games console can reasonably be expected to last a lot longer than a year, so as long as it hasn't been misused, Argos have a duty to sort it. You'll need to be firm, tell them this isn't acceptable and you expect it fixing. Don't deal with Microsoft - Argos sold it to you, it's their job to fix it.

You'll need to be firm with them, so if you don't want to stand up to your old boss, go via head office instead.

I knew that argos have a responsibility to fix it. but I just did what I was told when I worked there. :(

I will be going in on saturday for a chat. but in the meantime. I sent Microsoft this e-mail
My xbox 360 slim has been having problems for a few months now. Games freeze regularly, xbox live disconnects randomly despite my internet connection being intact and the console is extremely loud.

I went to book a repair for my console on your website but It told me my warranty expired 1 month ago and there would be a charge for the repair.

In accordance with the Sales of good act 1979, Goods should last a reasonable amount of time. 13 months for a £200 console is in my opinion not a reasonable amount of time and if the console has developed a manufacturer's fault, It is very unreasonable to expect me to pay for the repair.

I would like to send the console to be repaired, if the console is found to be a fault which is down to my error, I will pay for the repair, but if it is a manufacturer's fault. I would not be willing to pay.

Please send me information of how it might be possible to do this.

    Regards.

I don't write many e-mail so not sure if I worded it correctly but I just want to get this sorted. :)
I try to help as much as I can. But I'm also honest and speak my mind.

Long story short, no you didnt write it correctly. SoGA is legislation that is only relevant between the consumer and retailer. It is not applicable to B2B contracts and it is not applicable to consumer and manufacturer relationships.

The "report" to determine whether the fault or not is supposed to be independent. If you did the report personally, wouldnt be hard for you to say its inherent. Likewise if they did the report, they could just say its not inherent and is wear n tear/misuse. In other words.....independent = no vested interest, unbiased etc.

The only time we usually advise posters to go via manufacturer is if it is the path of least resistance (ie they'll repair/replace free and the retailer are being a *bad word* and refusing to do anything). Since MS are not offering anything (which they dont have to since warranty has expired), it would make sense to go back to the retailer.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
