Xbox gone wrong.

My xbox is now unplayable. It either boots me offline every 5 minutes, freezes or is incredibly slow. It also sounds like it's going to take off because it's so noisy. I have purchased a new one because I wanted to use this one for connect downstairs for christmas but I've just gone to Microsofts Website and it says my warranty expired on the 3rd of October 2011 and there would be a £65 repair charge.

Surely an xbox should last longer then just over 1 year. Am I covered under SoGA? How can I word an e-mail to microsoft about the problem explaining my rights? I would accept a repair or a refurbished unit, I just want my xbox working again.

I bought the console at argos as well but they won't touch it and tell me to go to microsoft :(

Any help would be appreciated.
I try to help as much as I can. But I'm also honest and speak my mind.

Smoke free since Jan 2014 :D If you want any advice on quitting please send me a PM. :)

Any action you might consider under SOGA should be against the seller... Argos.

Looks as though Argos need reminding of their obligations.

Have a read of MSE's excellent article on the subject.

Thanks for your reply! I used to work for argos so that's how I know they won't touch it. I've contacted my old manager to see if they can do anything.

Ideally I'd like to call microsoft. But would like to know what to say if they argue it's out of warranty.

Ideally what you want is 3 red lights or a E74 message, as Microsoft will fix those (as in give a replacement one) if purchased within the last 3 years.

As far as your system goes, the freezing could be a Cache problem, try clearing that or restoring the xBox, the virtual airport in your living room could be a misaligned fan/blade or a gunked up fan/dust issue.

So your options are Force a 3RL or E74 or get a independent report done and give it to Argos.

If Argos refuse to do anything you'd need an independant report confirming the fault is inherent and send them a copy. After 6 months the burden of proof is on the consumer. They would offer a (partial)refund, repair or replacement, effectively their choice.

You have no rights with Micrsoft if the warranty has expired.

Why? they have no obligation to do anything at present. Not until op has proof the fault is inherent that is.
  • How would I go about getting it accessed?

You are probably far cheaper paying the £65 and having Microsoft fix it to be honest!

But if the fault is found to be inherent, argos would have to pay the cost of the report - providing they request one. And might not be that expensive. Depends who does it. People have had reports for £20 before.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • With respect, the fact that you used to work at Argos means you know what you were trained to tell people when you worked there. Your old manager will almost certainly tell you the same thing - that he can't do anything to help.

Sadly, you were wrong when you told people that, and he's wrong now. A games console can reasonably be expected to last a lot longer than a year, so as long as it hasn't been misused, Argos have a duty to sort it. You'll need to be firm, tell them this isn't acceptable and you expect it fixing. Don't deal with Microsoft - Argos sold it to you, it's their job to fix it.

You'll need to be firm with them, so if you don't want to stand up to your old boss, go via head office instead.
