Single Yellow Line PCN

I tried to search the forum for relevant thread,

ON 5th August 2001 I received PCN for parking on yellow line in HA8 MANOR PARK CRESCENT

I Wrote the following email to Barnet council:

"I PARKED FOR A FEW MINUTES ON MANOR PARK CRESCENT OUTSIDE MELVIN ESTATE AGENTS BECAUSE I AM APPLYING FOR A JOB AT BEELINE MINICABS.

THERE WAS NO PARKING AROUND THE AREA CLOSE BY.

MR MASOOD, THE OWNER OF BEELINE CABS, REQUIRED TO VIEW MY CAR AND SO I HAD RUN ROUND THE CORNER STATION ROAD HALIFAX BANK TO RING THE DOORBELL FOR HIM TO COME DOWN.

I HAD ALSO TO SHOW HIM MY TAXI LICENCE BADGE.

IN THE SPACE OF A FEW MINUTES THE PARKING OFFICER HAD ISSUED THE TICKET AND HAD NOT GIVEN ANY TIME. I NOTE HE VIEWED MY VEHICLE FOR 1 MINUTE.

FURTHERMORE MY VEHICLE WAS NOT CAUSING ANY OBSTRUCTION AND I WAS NOT BLOCKING ENTRANCE TO THE CONSTITUTIONAL CLUB EITHER, I HAVE CONFIRMED THIS ON GOOGLE MAPS VIEWER.

I received the usual automated response from the council that they would look into it and today the 16th NOV I have received the NOTICE TO OWNER dated 15/11/11, more than 3 months later.

I phoned up council who say because I INFORMALLY appealled the 56 day response does not apply so I can resend the original INFORMAL appeal and it will be considered and I'll have the option to pay at reduced rate.

I don't know whether I can claim loading/unloading....I mean the car is THE ITEM so to speak to be viewed(UNLOADED FOR VIEWING).

please help

    Sorry mate, it's not unloading.

    I don't see any grounds in your letter. What did the signage say? Where was it located?

    You can not appeal a parking penalty with an excuse, scan the actual ticket and head over to pepipoo to see if a technicality exists

    Maybe ask Beeline Minicabs to pay up.
    Sounds like they were the ones who required you to park there.
  • Get onto the council website and put in the pcn number to see if it is still live. Councils rarely just give up and its possible that you may get a visit from bailiffs if you just hope its gone away. You need this in writing or the system will continue till the end with more cost to you.

    As I wrote in my first message the council sent a notice to owner and I gave the website for barnet council www. barnet.gov.uk/parking (I have had a space after www coz cannot post links) with my VRM and PCN number(to view their evidence). But I haven't got the original ticket because they took over 3 months to send the Notice to Owner letter without responding to my INFORMAL appeal (which you have read in my 1st message). So the council have today responded to my original appeal by email and say they are now giving me another 14 days to pay the original reduced £55 charge.

    I don't know the law for stopping on yellow lines for loading/unloading. My car had to be viewed for a few minutes by the proprietor. There was no parking close by. And as the car was what I was UNloading (for viewing) IMHO is that possible.

    Yellow lines prohibit waiting, but allow vehicles to load or unload for up to 40 minutes. Civil Enforcement Officers enforce on the basis of what they see happening, so if a driver is away from a vehicle making a delivery and our Civil Enforcement Officer does not see unloading taking place, a penalty may be issued. However we will consider cancelling the penalty if proof of loading is submitted to us.
    This page is about CPZs and I don't think that's what you are talking about, but I'm guessing it's the same principle.
    So you got a ticket because they didn't see you loading/unloading.
    If you can prove you were then they'll consider it.

    However, I don't think that someone inspecting a car counts as unloading the car. So I don't think that even with proof you've got much chance. But others might know better.
