Ebay returns to different address

I recently bought an item on ebay that when it arrived I believe is fake.
I immediately contacted the seller to ask for a return as his policy is to accept returns via paypal once he has received the item back. However the seller has replied that he is moving house in a couple of days and to give him my email account so he can refund me the amount and then he will send me his new address to post the object to.
I believe as a consumer I have 7 days from receiving the item to request a refund, however I believe his reply is a bit suspicious and may be a scam.
What would be the best way to ensure my refund?

  • How did you pay ?

If it was by paypal then I would return it to his registered address - and send it by recorded delivery (or if the price of the item is sufficiently high special delivery)

So the seller wants to issue you with a refund, then have you return the item to him in a few days after the move?
If so, not really sure what the problem is....

The best way to do it would be to ask for a return address (it's up to them to decide where they want it sending), send it recorded and await a refund

if you strongly believe this to be a fake then report it to ebay and then it will be upto the seller to prove it is genuine and if they cant then you will be refunded and wont need to return the item.

thats not right, ebay will simply class it as a 'not as described' case. The buyer will be required to return the item and provide ebay with the tracking ID whereby the seller is expected to refund within 3 days of receiving it (or is it 4 days?).

They are known though is some cases to offer a goodwill refund to the buyer and release the funds back to the seller -- depending on the case and value

Just a thought. If it's a fake, he may just be giving you the address to another of his victims.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

But its illegal to knowingly send counterfeit goods through the post.

There's been a few cases on here. AFAIK they took the item to trading standards who confirmed it was fake, retained the goods and gave them a letter that they showed to ebay or something like that. TBH cant remember every little detail, was so long ago!

I thought that was only if they was being sent out of the country ? Although you could be right.

I'm not really sure how you would convince ebay to refund though without returning the goods, especially if the seller denies they are

If they are fake, maybe contacting the manufacturer with details of the seller would help op....... the manufacturer will then report it to ebay under the VERO program..

Not sure. Just know it was discussed in depth on that thread and i'm pretty sure legislation was quoted but I might be thinking of another thread. My memory isnt the best for that stuff sometimes :D

Although most websites do recommend to contact your local trading standards (or consumers direct) if you suspect counterfeit goods. And if they are online, to report the website. Not sure how that would work with it being ebay 8-)

If it's the same thread I'm thinking about, it was faked goods from China and returning them (i.e. sending faked goods out of this country) is a criminal offence. Not sure about sending faked goods WITHIN this country.

Theres been a few! The one i remember about china was that they were shipped from the UK but they wanted the customer to return them to china.

The one that said it was illegal to send via post was around April.
