MINT / RBS reclaim

Hi newbie here.
Ive been asking the above company for copies of my old credit card agreement (2003/2006) to see if I had PPI on it, ive even sent them the cheque lol for the past month or so and today I get my cheque returned saying because my credit card isnt active they have no obligation to sent it to me.
At the same time I sent a letter to Cahoot and they sent me a copy showing I never had PPI now this has got me thinking are RBS not sending it because it had PPI on it (is this clear?)
My next step is to request copies of my statements so ive just been on the phone with them and was pushed from pillar to post until a lady said write back to the person from your last letter requesting the info and why.
Whats my chances? :D

    Hi there

    Did you request for just a copy of the agreement or a full SAR (Subject access Request) for £10 cheque or postal order?

    If the accounts are no longer active they say they are not obliged to keep a copy of this or send etc, but a SAR they must abide to the Data Protection act (DPA) and send all information they hold mainly going back the last 6 years, some will hold data going back to even earlier years.
    If they hold nothing at all then they must explain in writing and return your SAR payment.

    Its been known that some have said no PPI where in-fact there has been, and what some has done it just continue to make a reclaim anyway, by completing the reclaim questionnaire on step 3 below, good luck.

  • I didn't bother with all that I just sent them a copy of one of my statements, with my claim form. Based on this they paid up on my claim!

    Havent heard anything from RBS so I cancelled my cheque and im gonna send it again this week recorded delivery, im not letting this go :-)

    You could go to the Information Commissioner and say you have not had a response within 40 days.

    However, the bank is under no obligation to provide data that it no longer holds - or is not traceable from the information you have given.

    They had traced it because I never had my old account number but the person who replied giving me account number so they know who I am and I do think I had PPI and they are just being silly hoping I go away so this time ive sent my SAR recorded delivery so this time I will know they have got it and cant say it got lost in the post.

    And don't forget even though they receive the request recorded they are acknowledging your request (in some cases ) that they will deal with the request in 40 days .
    They may ignore your request like they did with mine I then chased up with another recorded letter and the response your signature and identity has to be verified before we can carry out this request.
    So three months on I am getting nowhere !
    Today I went to the bank and sorted the matter out !
    They have now issued me with my signature and I'd verification so I am now sending today.
    They deliberately are delaying my request because of the PPI claim I have made and the customer service Lady I spoke to at the branch agreed that this possibly be the case !

  • letter sent 4th Jan and im still waiting to get confirmation from Royal Mails track and trace system :mad:
  • Letter returned today stating signature didnt match blah blah and they need proof of my address eg bank statements or utility bill..................send time they have been a pain :-(
