Help with my contract

Need some guidance on my situation really; Got a 24 month contract HTC Desire (not HD) on 3 January 2010. They offered me an add-on a month ago for the all-you-can-eat data provided I pay an extra £3 a month. That took my monthly bill to £29. The day after I bought this add on they stopped me tethering to my laptop. I didn't know that I couldn't use it for this purpose and they never contacted me to tell me I couldn't do it since I purchased the phone 10 months previous!
I've registered a complaint because I've had loads of other problems with this phone and I'm just sick of dealing with them to be honest. They emailed me back yesterday advising that I am unable to change or do anything but as an 'exception' they can take off this add on and offer me the internet max add on which lets you tether to your laptop for a fee of £5.10 a month. So I'd still end up paying more money despite them messing me about!! What would you guys do/do I have much of a case??
Any help would be appreciated

What case?
They stopped you doing something that you were not allowed to do: Tethering on your phone.
They offered you some add-on and you took it. You can remove it if you don't want it.

Tethering has NEVER been allowed as part of 3's t&c's

unless you buy one of their new bundles - which they have offered to you.
I think that you were extremely lucky to have got away with doing it as long as you have.
Bottom line is - if you want to tether - you have to pay.0 -
Of course I understand that if I want to tether I have to pay and that the contracts weren't designed for this purpose and I accept that.
My problem lies in the fact this was not commuicated to me when I bought the phone and then again when I was offered the add on. It almost feels as though they waited until I took the option to up my allowance before then cutting me off just to get some more money out of me. 10 months is a long time for them to not notice I was using it for this purpose.0 -
Did you ask 3 if you could tether? from my understanding they are not obliged to tell you about every single scenario which you may use your phone for.0

You will needed to be guided by what the explicit terms were of the contract you agreed all those months ago. Was tethering mentioned? In not, then there is no right to it - and if they subsequently modify their network to actually prevent tethering your chances of complaining successfully would be slim.
It appears they are offering a work-around so that you are not disadvantaged, which will be seen as a 'reasonable' compromise (at least, better than taking out 2 concurrent agreements). If this is not to your liking, then you could certainly reject their offer, and continue the contract until you can leave after the minimum term lock-in.
As a reason to terminate without penalty, you can certainly ask, but if they do not agree, you cannot do anything further to force them.0
