Er... no. You are still creating debt.

Yes but repayable by other means.... :rotfl:
If you keep on doing what's you've always done, you'll keep on being what you've always been...
  • Thank you TakingControl for your reply.

I cant remember when I took the MBNA card out I know it was after 2007.

I never have recalled signing a credit agreement for it; maybe thats why they cant provide it!!??

Obtaining future credit doesn't bother me; if I need anything my partner gets if for me then I pay him back for it saves going into more debt!!

If I cant get things sorted out with MBNA, then I will have to look at a Debt Relief Order I might not have an option if MBNA are reluctant to provide the paperwork.

I can prove to the Insolvency I have tried to contact MBNA without success through all letters I have sent.

Being on benefits is a financial struggle at the best of times, I've been trying to look for a job without success even part time not much going!!

If you took the card out after 2007, the regulations as to what needs to be supplied as a CCA are a tad different to say a card pre-2003. So I would be careful to rely on this not becoming enforcable.

As a previous poster said, if you did a online application and ticked the box, this is sufficient as you agreed to their T&C at teh time and a reconstituted CCA is more than enough to make this enforcable.

Personally, I would write to MBNA with a income and expenditure list and offer them at least a token payment of £1. From all my creditors I found them easiest to deal with and they never defaulted me dispite being in a DMP and after 15 months in a DMP they accepted a 55% Full and Final payment from me, no defaults etc.

I would contact CCCS or another charity and get the correct info what is required from your lenders with regards to your debts and the opening date of the card. Worrying about a CCJ etc for 6 years is a long time.

  • Thank you TakingControl.

You have been the most helpful here and not judgemental and I appreciate it.

I might write to MBNA as you say and ask them to accept a £1.00 offer a month.

Should I ask them to stop adding interest as this is all I am paying each month and nothing off the main balance??

Can I ask who CCCS is and do you have their website address??

    Many thanks.

Before writing to MBNA, I would definately give CCCS a call and discuss your situation and they will be able to give you the best advise.

CCCS is a charity that helps people in financial difficulties with advise etc. All contact details can be found on www.cccs.co.uk

  • Thank you very much I will give them a call.

I have typed up a letter to MBNA to be posted tomorrow as you have advised. I have asked them to stop adding interest as this is all I am paying. I have offered them the £1.00 token gesture to pay this each month, then in the meantime I can save up and pay it off.

If they can agree to stop the interest this will also help me!!

Will keep you posted, again many thanks for your advice you've been brilliant!!

No that is not true you are only financially links if you make a joint application!!

I didnt ask to become unemployed by the way and I think the attitude towards people on benefitsd is disgusting.

And by the way as for the cheeky comment about internet access he pay for it not me.

I though this forum was for help and advice not to be put down and be rude to!!

Shame on those who have been nasty.

This forum is here to help and give advice. This is a money saving site and not a money avoidance site.

Best of luck on whatever you do. Chin up buddy!

  • I didnt ask to become unemployed by the way and I think the attitude towards people on benefitsd is disgusting.

People's attitude towards those on benefits isn't what's disgusting, the attitude of those on benefits expecting a free pass on their responsibilities is what's disgusting.

The type of benefits you're on are designed to keep a roof over your head while you find a job so I'm sorry if not everyone agrees with me on this but you should be focusing your energy on finding a job, as should anybody else on JSA.

Everyone on here has stated the same yet you've decided only to listen to those answers you like regardless of the valid points everyone else has raised. Stop complaining and pay back what you owe.
