Pagazzi Lighting - Farcical Purchase

I had a wander round Pagazzi Lighting in Falkirk on Saturday and ended up purchasing a new light for my kitchen. Over the weekend it became clear that my new kitchen is not going to happen until after christmas, so decided to take the light back.

I checked the reciept and realised that the item must be returned within 7 days to get a refund so phoned Falkirk to check that I could return to another branch, Uddingston is nearer my work. They said that would be fine, so I travelled there tonight after work.

Tonight, at Uddingston, I was told by the staff member that this item was on sale so could only get an exchange or credit note.

I explained that no mention of this was made at point of sale and infact I had not realised the light was on sale (it was £39), there was no marking on the packaging to indicate that the item was on sale. He showed me the part on the reciept where it says there is no refunds on sale items (too late by the time you get to the reciept stage methinks).

He would not budge and I was losing it to be honest (not my best moment) so I agreed to the credit note, before I exploded. He made up the paperwork and came back with it and casually mentioned that I would only be able to use the creditnote in that store - Uddingston. I had another wee meltdown about that and left before my day got much worse.

Was there anything else I could have done?
I have the email for a man I can complain to, which I will. Has anyone got any advice?

  • If there was something written on the receipt that attempted to remove or reduce your statutory rights then this would be unenforcable and illegal.

    However, as no retailer is obliged to accept any goods back for a change of mind (providing that the purchase was made in a face to face transaction), then they are at liberty to state the no refunds for sale goods term.
    They can state this either before or after the sale as in this case.

    The only time that this wouldn't apply is if they had a notice in the shop stating that goods could be returned within 7 days and this made no mention of the sale goods exemption and you only found out about this after paying.
    This is because although they don't legally have to allow returns, by having a notice stating that they will means that their return policy forms part of the contract of sale.
