The issue is resolved - there's nothing more to say - im not about to get in to an argument over who's right and who's wrong - i do however find it amusing that you have nothing better to do that keep posting snide comments about me - very entertaining i must say.

    BTW - the big open space below my post is left open for you to get the last word in - let's see if you can resist? :rotfl:

    If a company give a goodwill gesture, consumers still pay for it eventually as the company will just work this into their profit/loss adjustment.

    I am glad you got a good result however, I do feel the need to point out that when you order goods online there are downsides and certain things you should be aware of.

    For instance, you could've been liable for sending the item back via mail (and not have them collect it). If goods are sent to you that you dont want to keep, providing they've not informed you prior to the contract being concluded that you need to organise its return, your duty is still to take reasonable care of the item and make it available for collection.

    If this is a small item its not too much hassle. If you're ordering a big item, its something you should take into consideration.

    As for being a fire hazard, i'm sorry but i dont see that as their responsibility as they didnt choose where the item was being stored. While it may have been an inconvenience to store it on the sofa or in a corner somewhere, it wouldve prevented the "fire hazard" you mentioned. Not saying its your fault either as perhaps you have a tiny home. Just that I dont think they're directly responsible for it.

    There are many good points to ordering online, but not all are good :)

  • Thank you for the constructive post - i see your points, but do disagree with some:

    Any company (such as the one i purchased from) probably send out hundreds of parcels each week - their courier costs would be minute - how else could they offer next day delivery for £3.95 on their items (they deal in large/bulky items only). If damage occurred the company would claim any loss back from the courier company - i don't see them being out of pocket - if they are the costs are minimal.

    I did take reasonable care of the damaged item - apart from my hallway where it is stored, the only other place would have been outside in it's box out in the pouring rain - they wouldn't have got back a product in the same condition as i received it in - thus making me liable!

    When you say it's not the companies responsibility for how/where i store the item - it's also not my responsibility to try and store a damaged item - i didn't pay for and order a damaged item so why should it be my responsibility to try and store it or dispose of it?

    The long and short of this is that the company told me they would take away the defective part and they failed to carry this out. There are not legal requirements involved - the company should be told/prompted to do what's morally correct - they promised to do something and didn't.

    I knew my legal stance within the first couple of posts - it just would have been nice if people would have said 'you know what, even though legally they've got you over a barrel, how about you try this....' it may not get people anywhere, but then again it may - just a suggestion, my thread was not the only one ive read through tonight that has had some non-helpful posts thrown in for good measure - it doesn't give this forum a good reputation does it?!!!!!

    The issue my end has been resolved - so thank you to the few people that helped/contributed :)

    lol that did make me laugh - i don't know how big your bins are mate, but ours certainly wouldn't fit a 5ft x 3ft plastic box in - have you read the requirements for household waste? they certainly don't include animal cage base's - our rubbish collection have in the past left card board boxes behind as they don't fit the requirement of household waste as they can be recycled

    I'm going to leave this thread now, as i think it's going round in circles - i did mention the fact i couldn't dispose of it in my first few posts and the reasons behind this.....

    Feel free to continue this very interestingly boring topic without me....:D

    Lay it on ground upside down, place foot heavily in the middle, lots of little bits to put in bin. Good exercise, releases frustration, blood pressure reduced. The simplest solutions are usually the best.
