Returning an item?

    You've been sent a replacement so as far as I'm aware they've covered their obligations on that front. I don't think they legally have to have the damaged goods returned.

  • Thanks for the replies - thankfully this has all been sorted out and the company concerned have arranged to collect the defective part - i think a little persistence and not taking things lying down does the trick ;)

    I told them that i'd been in touch with consumer direct and trading standards - i also made mention that they'd promised to do something and they didn't do it which basically left me inconvenienced. In the first instance i didn't ask to have a damaged item sent to me (company fault number 1), promising me that they would take the defective part away then not doing so (company fault number 2) - these two problems i never asked for and shouldn't have had. Why should i be left out of pocket for something which was beyond my control?

    My wanting to send the item back was merely me making a point - which in this instance worked in my favour and got what they originally promised :)

    ....Oh dear. The scary thing is you have a really poor comprehension of DSR and SOGA and this will bite you on the arse in the future I'm sure if you come up against an e-tailer who does.
  • What? You've gone wayyyy past the original point - this was never about DSR's or SOGA - hell that's one minefield i don't even understand (if i did i wouldn't have come here for advice, would i?)

    The original point was that they'd promised to collect the defective item and they did not - i made a threat of cancelling the transaction to make them realise that as a company they cannot make promises and then leave their customers in a mess. If i'd have jhad to seen through actually sending the item back, i wanted to know my rights (hence my OP)

    All you kind people alerted me to the fact i had no chance - i tried something other than you telling me to take it lying down and the company responded in a positive manor - i get to keep the product i ordered and have the damaged part taken away - they get a happy customer, who may even be tempted to recommend them to others :rotfl:

    Thanks for all the advice in helping me get the damaged item taken away - it really helped strengthen my case....

    I think what people tried to point out to you was that legally you could not insist that they collected the item as they had met their obligations in replacing a damaged part. I am no fully aware of the ins and outs of those regulations so whether this advice was correct or not I do not know.

    Assuming the advice you received was correct then you have been lucky and the company have done it as a goodwill gesture in order to keep a customer happy rather than because they were legally obliged. You may in future come up against a retailer who is not as generous.

    I think that's where people got confused - i made the company aware of the damaged part, they told me they would send a replacement, i asked what i should do with the defective part as i had no way of disposing of it - they then assured me they'd arrange for it to be collected when the new one was delivered.

    I'd always said i didn't think it was fair 'after they'd promised' to take the damaged part away that i should be out of pocket to dispose of it myself or be inconvenienced by having it create a fire hazard in my home.

    The only legal requirement i asked for was whether they could take a chunk of money from my original transaction payment - as others have pointed out, yes they can take money from my initial payment before they issue a refund.

    it would have been nice if people gave suggestions on what i could have said to help my case rather than tell me i don't have a cat in hells chance legally - oh well, we don't always get what we want....

    I was bought up to fight for what i believe in - if i believe im right them im going to fight for it - it matters not if i lose, at least i lost trying for what i thought was right - heck i knew i didn't have a chance at school (17yrs ago) of winning the 200m sprint, but i still gave it my best shot!!!!

    This site is called money saving expert for a reason - the idea (or so i thought) was to save money, not just roll over and take it whatever way.......
