Returned item is lost, paypal dispute

Hi

I brought an item about a month ago from Ebay for £125 , the item was faulty so I contacted the seller, no responce from them so I opened a paypal dispute.
Paypal asked me to send item back, which I did signed for,but its been a few weeks now and all the tracking number is basically saying is come back later. usually if it hasnt got there yet it says "item was posted on such a date and its on its way"
If the seller never gets the item back will I loose my money?

    What postal method did you use? Hopefully not recorded.
  • If you used recorded delivery it may never get a signature, so hopefully you used special delivery or a courier, in which case you should be able to claim from RM or the courier, however if you sent it recorded then you are only covered for up to £46 and the most likely form of compensation you'll get is a book mod stamps, that's why you should never use recorded

    lets say the buyer decided not to sign for it then surely paypal would refund me? as I have showed proof of posting with tracking number?

    You only have proof it was posted though, not that seller has it. So you would almost certainly lose a paypal claim unless the tracking updates- but you can claim your loss from Royal Mail as you have used the correct service for the value of the item.

  • If the seller refused to sign for the goods and this was shown on the RM tracking page then you there is a very good chance that you still win the dispute as paypal will often accept proof of attempted delivery for dispute purposes.

    "come back later" normally means the item as not been posted yet.

    Double check tracking (make sure '0's are not 'O's etc - then ring Royal Mail.

    As Special Delivery is next day delivery - it should have been there ages ago. Royal Mail see a slightly expanded tracking record than what we see - so it may be that its just not updating online.

    As it stands - you could lose the claim with paypal and may have to claim from Royal Mail.

    I don't know if lack of response from the seller would count in your favour - as in my claim for item not a described with boffer - i got the money back and kept the goods - as boffer failed to respond. But your claim is different, and paypal have told you to return it.

    Its now saying this?




    We tried to deliver Item could not be delivered on ??? (and no Safeplace option was specified by the addressee). A"something for you card" will have been delivered, the item will be returned to ??? pending instructions from the addressee. You can arrange a redelivery online, call the ??? office to arrange a re-delivery, or collect the item from ?? by bringing proof of identification and address.
    ????? is what I have deleated.
    usually if no one is in they just say they "tried to deliver item but no one was in so we have left a while we where out card"

    so does this mean that they have refused to sign for it?

    Go back into the dispute & say that RM have tried to deliver, the case should then be closed in your favour.

    I posted a car amplifier (sold for £30, value to me £100) and they lost it.
    Wrote to them, filled the form in, and they gave me a book of stamps!!
    WHy not the £100? Or at very least £46?
