Vehicle use and ved disabled exemption.

I have been posed a Q. which I don't know the answer and would appreciate some insight.

The person is entitled to ved exemption due to a disability. They are about to be offered a job where the employer has asked them if they are prepared to use their car for undertaking the employers business - this sat uneasy with them however the employer subsequently informed that the disabled person may have to collect and take with them other employees.

Does this comply with the conditions affecting the provision of ved exemption? (any further info and i'll do my best).

    Is using the vehicle for the employer's business of direct benefit to the person eligible for VED exemption? Bit of a grey area. It benefits the employer but.....
    You won’t be able to get a free disabled tax disc if:
    • the vehicle is not used directly for your purposes

    The use is directly for the recipients benefit/ purpose - a job. Other facts are incidental.

    As above. The person needs to be aware that they have to have business use added onto their insurance policy unless the employer does (GET PROOF!!) or they will be uninsured whilst driving their car for work.

    I've already discussed the implication of insurance with them. The possible contention is whether they will fail to meet the condition of ved exemption - this is not an area I'm knowledgeable in and information appears to lack clarity.

    The primary use is most definitely for their benefit, however an employer would appear to be reaping a potential benefit.

  • you can take your work colleagues or do what ever you like the car tax is not the issue, it is your insurance. if your gaining monetary reward or benefit in kind from taxi'ing them around then you need business insurance. If its the odd lift to work then it does not matter
