    Thanks but I think it is a little more hopeful really, here is the final paras of the FOS response;
    FOS will provide the details of the underwriter if possible, but it will be up to you to complain to them. The Ombudsman will not do that for you.

    FOS are now taking it up. Sit tight for a good 12 months I reckon?
    It's difficult to see FOS being able to do anything in your circumstances. They have no jurisdiction over the lender because it was pre-regulation and the insurer are not playing ball either.

    If you expect nothing from this you won't be disappointed.
  • I am pursuing one of these from Sanderson Motorhouse, part of C D Bramall, part of Evans Halshaw, part of Pendragon Group. Phew!

    It dates from 2001, FOS told me that as the dealer was not affiliated to a recognised organization it would be difficult to make a claim.

    The loan was from GE Capital Woodchester, now part of Santander Consumer Finance who rejected the claim.

    The PPI Policy was with London General Insurance, part of The Warranty Group. I have made a claim with them which they have rejected as they say they were not responsible for selling the insurance.

    I have full documentation which FOS now have. Could be a very long wait.
  • Oh dear this thread don't bode well for me, I also had ppi which was GE Capital Woodchester that was mis-sold to me through the the car salesman when purchasing my car in 2003 payments over 60 months, the garage was Reg Vardy Plc, Vauxhall which also now is Evan Halshaw.

    So my question is who am I actually writing to? I thought it was going to be a nice simple one and straight to GE Capital but after reading this thread, I'm thinking not and now after thinking I will get money back am now left thinking I will be left with nothing.

    The car dealer. However, most car dealers did not become regulated until January 2005. So, in most cases, the dealer will refuse to deal with the complaint and its game over. Only where the dealer was an agent of the lender, would the lender have liability.

  • I too bought a car through woodchester in 1997 paid over 4 years. I have no details at all, but it was bought through charles hurst renault. Is there anyway of chasing this. I'm not 100% sure but believe I was sold ppi. I was 18 and just delighted to be buying a car!

    Its pre-regulation. You can complain to the dealer but chances are they will tell you its pre-regulation and reject the complaint. A small number of cases through dealers will see the lender take responsibility (such as some car dealer branded lenders).

    I bought a car through GE capital Woodchester in 2005 and was mis-sold PPI. Made a complaint to Santander who didn't want to know even though I was paying the premiums to them after they took over GE. The car dealer is no longer trading. I have an RAC warranty document stating that the policy is called RAC Warranty Prestige Total Loss GAP Insurance and the underwriters are AmTrust International Underwriters Ltd with an address in Dublin. RAC Warranty is a trading style of Motorway Direct plc. Any idea who I should approach next?
    Thanks

    Santander didnt sell it though. The car dealer did.

    The FSCS (assuming it is after 14th January 2005)
