Even though I have wrote a reply to the FSCS which I have just posted today following Amersalls advice:), I am just reading through these experiences again. I am still fuming so I have called the FSCS admitted that I am currently looking at a forum and can see people with exactly the same problem as me who have recalimed directly from their, still live, providers who have had the diffeence repaid without any problems. I have been told by FSCS that they are following the rules. Its not my fault that Freedom Finance have gone bust. They were quick enough to take the money but mysteriously quick to shut down when they thought that they would have to repay :mad::mad: but I don't think they will change their mind :cry::cry:

Hi Shelly. Are you saying you told the FSCS that your complaint "was not" about misselling? That could be the problem as where insurance brokers are concerned they only usually look into misselling complaints.

I understand where you are coming from though in that you accepted a gesture of goodwill payment that was shorting you of the full amount of the missale but I dont know how they can reopen the complaint as you signed full and final? I wonder if FOS would have any ideas on this one or maybe even ring or email the FSA? Also what about getting your MP involved in it and did you get a fair rebate too when you settled the loan only 12 months later? Perhaps your other avenue would be a rebate complaint (though not the full amount of misselling) to the insurer if you only got a small amount rebated that was not pro rata?

    Good luck

Hi Marshallka, Yes I think you are right, in my calmer moments  I think I understand where they are coming from. I'm angry because I explained all this to them on the phone in great detail but they still allowed me to go through with it. I'm angry that, had FF not not gone bust, I would have possibly got the difference back like some of the other posters. I feel very sorry for the FSCS lad who I let rip on today, its not his fault - I'm a nasty person :o
I appreciate your other suggestions and I will definitely look into persuing them. I won't stop until I have done everything I can.

    Hi marshalka,hows tricks?.

I wonder how many people were suckered with this type of ppi,to take a good will gesture and not know that the whole ppi was still there on the loan to term end with interest, and that you would not be insured after 5 years?.

Never thought about unfair rebate, the way these loans work any rebate is unfair, didnt you win unfair rebate at some point?,maybe this is where shellleyb 1 should be looking?.

Hi amersall. Not too bad thanks....yes, I won on the rebate side of things but looking at when shelley settled (2008) maybe it was actually fair (as fair as FOS would say that is but still very unfair to us).

Mine was settled in 2003 so they still used rule 78. I hope she/he gets somewhere with this one. I hate seeing people in this boat. It makes my blood boil. I will have another think.... :D.

    Hi Ammersall, Marshallka,
Just to let you know that the FSCS have replied to my appeal response but have not changed their mind. I do accept the reasons given basically the same as you both have said. I feel that I have done as much as I can and at least I tried. I would just like to thank you so much for helping to try you really are good :A. I have a few more fingers in a few more pies with a couple other claims which are proofing difficult (just for a change) I am sure that I will have a need to ask for more help at some point for these!!!

    Thanks again

What about a complaint regarding the "unfair rebate" when you settled as Marshalka advised?, this could be an avenue worth pursuing?.
