Fake software on Amazon

I Bought Photoshop off Amazon from third party trader and sometime after found I could not upgrade as it was fake.
Contacted Amazon and they said I had product more than 30 days so I could not get refund.
Claimed section 75 on my credit card and they refused even though they say customers will not be victim of fraud on line
Took case to FOS and basically they refused to do anything either.
Amazon claims they do not allow fake software to be sold but they are still letting sellers do this
What can I do next small claims? Or trading standards

You could try contacting the seller through Amazon, and telling them that if they don't refund you, you'll report them to trading standards.
If that fails, and the item was described as a genuine copy of PS, then get in touch with either consumer rights and go down the item not as described route or your local council's trading standards department .

How long ago did you buy it?
Was there any other indications that it was fake? Did it activate correctly? Has an authorised third party confirmed it is fake?0 -
You could try speaking to Adobe. Although you might not get much luck in terms of getting what you paid for, they'll probably have more clout in terms of getting the software removed from Amazon.Competition wins: Where's Wally Goody Bag, Club badge branded football, Nivea for Men Goody Bag0

If Amazon say they dont allow fake software how can they control a 3rd party?
Why would you complain to them if it was genuine copy? the only logical conclusion its must be a fake0 -
I received a letter recently at work that was from some company that deal with software pirating, if stated if you know anybody using or selling unauthenticate software (including your employer :eek:) you may receive a reward for reporting them.
If I can find the leaflet i'll post the details, it would be worth a try atleast.0 -
if fake softweare is being sold then the only ones that can nget Amazon to take these out is the copyright ownwers like the ebay Vero scheme. contact Adobe and explain to them, give them the sellers link. etc.
as what they would do is have an agent make a purchase of adobe software from the seller and then they will test the software to make sure it is genuine and if it is fake then abode will use copyright powers to have amazon take this seller items down etc.0 -
It sounds like you need to push the Section 75 claim again.
From Martins MSE guide "it's a legal protection put in place so that you're never in the position of paying debt for something you didn't receive or wasn't as it should've been."
What have you told the card issuer?0 -
How much did you pay for it?
If it was less than £100 then this may be why your card issuer was refusing the S75 claim.0 -
Any fake software I've came across has been fairly easy to spot. OP did the software look legit.?0

If you paid more than £100 for it (which you surely did, otherwise that should have instantly raised red flags) then section 75 should definitely apply.
Did you receive a licence key for it and activate it normally? Or did you receive instructions to use some kind of patch or key generator?0
