Game dispatched to wrong address

Basically,
I ordered a game last night from shopto.net, whilst ordering, I updated my old billing address to my new one, and there was a message saying that your first 2 orders on the site must go to your billing address. I did not see a confirmation screen confirming my details whilst I was ordering, but when I checked my confirmation email, it was sent to my old student address, which is not one of either of my billing addresses, but an old shipping address that I tried to use on my first order.
I tried to cancel the order, but it had already begun processing immediately, I checked my delivery address on the website and it was set as my new billing address, and wouldn't let me update it until the order was dispatched. I sent a support ticket querying which address was being used.
I then received a dispatch email this morning showing the package being addressed to my old student house and I rang up shopto to see if they could do anything / why this happened. The woman told me that it wasnt sent to my billing account because pre-orders act differently, but this order wasnt processed like a pre-order, but like a normal one. And the package wasnt tracked either.
I am currently relying on the goodwill of the strangers in my old house, but if not, what are my rights? Surely this is their fault? I havent updated my shipping address at all, and it currently says my billing address.

so its a companies fault because you never changed the address till you placed the order.
Your mistake for not updating your account.0 -
Well, the first order went to the old billing address, not the shipping address. And I was never given the opportunity to choose my delivery address when making the order, just told that the first 2 orders on a site would go to the billing address. The address that it was sent to, was neither the current nor the previous billing address.
The shipping address is saved in the account section, and I havent changed it myself since I put it in originally, but it currently says the new billing address. I am confused as to why it didnt go to either billing address, and why there was no review of the order before payment.0 -
So during the order process you entered a billing address? As the website states your first two orders will go to the billing address you naturally assumed the order would be dispatched to this address you entered. And they sent it to a different address?
:huh:0 -
Yeah, it was to an address I previously tried to have my first order sent to, but was unable to as it wasnt my billing address.
After the order, my confirmation had the address it was sent to, they had my billing address being the old one. And they had my shipping address down as my new billing address, so they didnt actually have the address it was sent to on my account at that point lol.0 -
Shopto are usually very good at sorting stuff out. Let them know what happened and see if they send another one out? Especially as their orders are usually sent recorded delivery so if somebody at that address signs for it then they are committing fraud.0

so if you are not in and the post arrives and a good neighbours takes you mail in then its FRAUD./ THINK again on that as if it was then couriers/RM would never be allowed to leave mail at any other address other than the addressees0 -

I know thatHeck i even know that people can open mail addressed to someone else providing they're not doing so with malicious intent.
