    Employers are very sly at doing this... picking another reason. I was dismissed for joining a union but on paper they put it down to poor performance.

    Care work is also exempt from 11 hour rule I beleive. I have often in both my jobs finished at 9pm and been back in work for 6.30am.

    I have started at 6.30 am then finished at 10pm (ish) And started following day at 6.30am.

    BUT being on the road, we do get an hr break between morning and lunch then an hr or so between lunch and tea, but nothing between tea and bed.

    I wonder if the 11 hour rule does apply to care workers?

    The exemptions state
    The rules apply differently if :- The job needs round-the-clock staffing such as hospital work.
    Care workers probably fall into this catagory.

    Look at this 11 hr rule,

    allthough it may not apply to certain types of roles alternative rules are recommended.

    direct.gov summary

    In these cases, instead of getting normal breaks, you are entitled to 'compensatory rest'. This is rest taken later, ideally during the same or following working day. The principle is that everyone gets a minimum 90 hours rest a week on average. This is the total of your entitlement to daily and weekly rest periods, although some rest may come slightly later than normal.

    A standard week breaks with WTD
    24 hr
    5 x 11hr
    6 x 20mins (2hr)

    So thats 81hrs (doing it on the 2weeks cycle its 74.5 pw)how they get 90hr I am not sure (probably related to the weekly break not including the daily break but not seen this itemized).


    The basic point is that any legal break can be taken later in jobs that qualify but you still get them.
