    He also has an hour and a quarter each way travelling. If he worked closer to home the 11 hour rule wouldn't matter so much.

    The 11 hour rule applies to all workers apart from those in the excluded sectors (mainly transport workers, police, armed forces etc) and there is no exclusion for training periods. Your son's employer is therefore in breach of the regulations.

    What he actually does about it is another matter. If he has only been there a couple of weeks, he can raise a grievance and whilst a dismissal for doing so would be automatically unfair, he has no protection should the employer trump up some other reason for letting him go.

    Employers are very sly at doing this... picking another reason. I was dismissed for joining a union but on paper they put it down to poor performance.

    Care work is also exempt from 11 hour rule I beleive. I have often in both my jobs finished at 9pm and been back in work for 6.30am.

    From memory, there is no blanket exemption for care workers, but there is an exclusion for workers changing shift patterns from, say, lates to earlies where there would be no time for an 11 hour break.

    NMW is calculated over a pay period or 1 month max.

    Did not realise this. He will be getting paid monthly.

    I will monitor his hours for him for a month or two.

    I just wanted to know about the 11 hour rule, wage is not really a problem as such as that can be worked out.

    Once he passes his driving test he can have my car to use which will cut down his travelling time, which will make his life easier.
