Xbox 360-unplayable disc eror???

Please help!
Purchased core system from GUS in November for my son's xmas pressie. All fine until today when whichever game we put it, or DVD, the console makes a strange noise & then an error message comes on screen 'unplayable disc'
The console has never been moved with a game inside and there are no red lights, and the system is well ventilated
I telephoned GUS who said that if the console was purchased within 30 days, they could exchange, but as it was over this, they just gave me the no. for Microsoft.
After phoning Microsoft, they have suggested that the console is faulty & they are sending a courier to collect it. I am very concerned, especially after reading other threads on here, that they may well just send me someone else's recon Xbox.
Has anyone else had this particular error?
Does anyone know what my rights would be IF I get sent a recon one?(Bearing in mind that this was Xmas gift and has only been used 1 month)

I had a similar problem in october bought it from game they just exchanged it there and then although my son had only had it for 17 days, they said they'd had afew back and it must be a faulty batch, I don't think you'll get a recon from MS in the first 12 months but after that who knows.

There has been another thread on this board where someone returned thier Xbox that was 3 months old and got a recon... It seems to be the way Microsoft do things.0

I would have that under the sale of goods act who ever you bought the 360 from would have to exchange it for you, gamestation & game certainly do.

Contact Gus again and tell them that you bought if from them the cntract is with them not the manufatcurer. it is their responsibilityu to provide you with an item that is sutable for the purpose it is intended to be used for. It is ALWAYS the Seller NOT the Manufacturer, who is responsible to correct any faults.
There is NO set time in Law, whereby you are entitled to an automatic Full Refund. The Law just says, within a reasonable time. But if the item shows signs of being faulty within a short period after purchase (usually 14 days, but almost never after 28 days) you are entitled to a FULL refund, as there is a supposition that the item had a fault from day one or manufacturing and is therefore Not Fit For The Purpose. But as this is a very time limiting period in Law, you need to act swiftly to invoke your Legal Rights, should this occur.
Make sure you keep a record of everything that happens, dates and times times names of who you speak to. I would also send a writen letter the GUS by recorded delivery telling them what you want, state it was a chrismas present so has only been used since 25th december and that you originally reported the fault before 28 days were uphopfully you will be telling the truth. mention it isnt fit for purpose and you would like a replacement or full refund.
How did you pay? hopfully by credit card if you did inform GUS in the letter that if you dont get a satifactory response within 7-10 days you will contact your credit card company and claim under the Consumer Credit Act 1974 to recover the funds you paid for the item. That usually kicks most companies in to acting quickly. I have also found that sending the letter to the company and also send it to the credit card indicateing that you have with CC: "credit card company name" on the letter everything you send needs to be done by recorded delivery. so they cant turn round and say they never got it.
GUS is a catalog correct?
in that case it is the distance selling regs will also apply. Check their T&C's to see what their returns policy is, who pays etc. if they dont mention one tha you need to pay for the return then all you need to do is package it up and make it available for collection.0 -
I had a similar problem myself. Used to get it with Oblivion. The 360 will update itself every so often, and that fixed it for me.
I wouldn't worry too much. Even if you get a refurb unit, it should have been fully checked over and rebuilt. Not all units off the line get checked."Boonowa tweepi, ha, ha."0 -
Yeah - I'd listen to what Little John is saying. I'm the unfortunate guy that Scooter was talking about, and I wish I didn't get involved with Microsoft.
I've since contacted a site called Consumer Direct (a government site I think - just google it) and they suggested that you should seek a replacement from the seller, not the manufacturer. The site gives advice on this type of thing and states that if the console breaks within 6 months of sale, then you can assume that it was broken on purchase, and therefore you can deal with them...
After speaking with them about my situation, it seems that because I have now dealt with Microsoft, it could confuse matters if I now dealt with my retailer (Virgin Megastore). Quite gutted about this really as I got in touch with Virgin as soon as it broke and they said they would not deal with it.
If I were you OP I wouldn't deal with MS until you get this advice and maybe contact the retailer again. After my 1st console was replaced with a refurb the 2nd broke after about 3 hours play. Now waiting for console number 3...0 -

Have just rang them again, fully equipped with the DTI's sale of goods act in front of me, but, the supervisor I spoke to was really sympathetic, and whilst she said it was their policy to req cust to deal with the manufacturer, she said in this case (the fact it was only opened at Xmas) she would authorise a replacement for me.
She has arranged for a courier to collect the XBOX 360
I have her full name etc. so I hope there won't be any further problems.
Just have to hope that the new one lasts a bit longer!0
