child broke leg at school....

Hi my child fractured her foot and leg falling down steps at school, I have since found out the steps are in need of repair (crumbly/chunks out of them). Repairs have started yet no one from the school has actually told me about this! what would you do?

    Are you asking whether you should claim compensation? If so, well, I would look at the circumstances.

    1. Am I financially less off since the broken leg (Is my child bringing in an income we depend on)?
    2. Is she going to be left disabled? Will she need specialist medical equipment for the rest of her life?
    3. Is there physical scarring to the extent that she will need plastic surgery?
    4. Was she walking where not permitted?
    5. Have you seen the steps yourself?

    If none of the above then, no, I don't think I would claim.

    Nothing. If you sue, I can't let them see your child staying there.

    Thats not true.

    They cannot make your child leave if you sue them.

    The school has insurance for this sort of thing and as I understand it you have some considerable time anyway in which to lodge a claim.

    OP - you say repairs have started but its not clear if your child has fallen down the steps before or while these repairs are being carried out?
    can you post back please? the distinction is important.

    hope your child gets better soon op, i'm not going to weigh in on the compensation argument but the steps should be in a good state of repair. that's the minimum you'd expect where children are concerned.
    Come on, it's not rocket surgery is it?

    Do you know what? I would ask for some sort of compensation, they have insurance for these kinds of things. Reason why I say this is because when I was in school I fell down some steps and broke my arm, 20 odd years later I am still suffering with it. My Mother broke her ankle tripping over a pot hole on a path, she suffers terribly with it now. Wish I sued the council... My mother did, she received a fair amount of money, not that it has made a difference to the pain she suffers, but made her feel as of justice has been done, they also fixed all pot holes...

    If you have to give up work (unpaid holiday etc) to stay at home to look after her then you are losing income...therefore the school's insurance should pay up surely?

    The school has a duty of care, if the steps were known to be unsafe and were not cordoned off effectively then they failed in their duty of care imo.
