3GS not working trying to change on 02!

I'm wondering if anyone can give me a bit of advise.
I have an Iphone 3GS on a 24 month contract which I am 7 months into. I have had problems with the phone from the start and took it back to Apple yesterday, my phone turns it self all the time and due to this I can't make calls now cos it turns off, the battery life is terrible and i charge it twice a day, which is not very good as a Photographer as I'm always on the road and need the phone to work!
The guy from Apple told me some very good info on the phone, he said this fault was common with the 3GS and is why they brought out the Iphone 4, they couldn't take the phone to be repaired as it was not a problem with the phone it is just how the phone works and he couldn't swap for another 3GS as they same thing would happpen again and i would just be back at Apple with the problem again.
He told me 02 are very aware of the problem and know that Apple won't fix the problem as they can't, they told me to contact them which i have by email and told them what happened.

I would just like a bit of advise cos I have no idea where i could go with this and also feel really annoyed that 02 know about this yet still sell them on contract!

    Sorry, you had an Apple employee say the reason they brought out the 4 was because of battery issues with the 3GS? They're having a laugh, or trying to upsell you a replacement! I have had my 3GS for 2 years, and the battery is fine but only now needing a replacement battery swap due to its capacity diminishing - this is normal. If the phone was new, SOGA ensures it will be fixed if a genuine fault. This is 12 months, and your retailer or the Apple shop should have told you of this. If you bought from O2, they need to organise a replacement battery (or handset at their discretion).

    Buzby is correct, there is no way a genuine apple employee told you that information (did you actually call o2?)

    if you are near an apple store make an appointment with a 'Genius' and they should give you a replacement 3GS with little to no questions asked. yes the law does say it is o2's responsibility to repair it but they will just mess you around and say stuff like 'that's why they brought out the iphone 4', apple on the other hand will just fix it.

    I myself have a 3GS and it (nor does anyone else's I know) have this problem, therefore I suspect that you just have a 'dud' and you should get it replaced under warranty.

    I kind of thought he was trying to sell me on the Iphone 4 through working in sales a few years ago but it wasn't cos of the battery it was due to the software error on the phone which the guy told me was due to there being a problem with the 3GS. My sister used to have this phone and she said her's did it too so maybe it is just a fault that can't be fixed but i just want the phone to work and he wouldn't take the phone in to be repaired because he said there wasn't a fault and I needed to get in contact with 02. My 02 store is closed and can't get to another one due to not knowing where it is and i can't rely on my phone incase I get lost cos I ring out of it.
    I ordered it online so will wait for a reply from them!

    Unfortunatly an Apple employee did which left me in shock and didn't know what to do so i just left and got in touch with 02. My phone won't stay on long enough to contact 02 which is why i have emailed them.
    Apple store is not near me and I don't fancy another trip so may leave it to the better half and see if he can get any joy? Maybe he saw me coming??? Haha

    If you ordered on line, great - stick to that route and do not visit an O2 store as it is the retailer who took your money has the responsibility to resolve these issues. However, have you checked what you have on? If you have GPS, Bluetooth and WiFi on constantly, your battery life will be seriously impacted - this is just physics, not a phone problem. You should get at least 15-18 months use of a battery before a replacement is required, and is often done for £25-£30 - but assuming yours was totally new at the point of purchase, you've got 12 months. Hopefully you've still got the receipt if they ask for it!
