If we take them to small claims and it is found in our favour, will they also be forced to pay all our costs invoved with invoking the claim?

If your garage said that the engine needs to be dropped out to replace the cambelt then let them drop it out and stick a second hand engine in instead. Most of the cost will be on repairing it but you'll probably be able to pick a replacement engine up for a couple of hundred quid and then it's just labour charges.
The majority of the cost is the dropping out and putting back in of the engine so I am not sure this would be a cheaper solution ?0 -
Just had a thought actually, should the warranty company not have had the van checked over before issuing it and subsequently any repairs done before we paid for the warranty shouldn't they have to take it up with the previous garage and not us?
Probably just clutching at straws here but I am so mad about it all...0 -
How much are they quoting for labour? it shouldn't take anywhere near 10 hours but even if it did, that's only £350 labour.
How many miles has it done since the cambelt was last changed? you might not get very far if it's done a rake of miles. If it's done 60,000 miles they could argue that the work was satisfactory.0 -
They have quoted 20 hours @ 50 an hour just to drop the engine out...
It has only done 26k miles since the last change.
Thing is if we had known we would have to pay it ourselves we could have shopped around but now they have taken the engine out anyway we are stuck with this garage and we only went there because it was the garage for the warranty cover !0 -
Tell them to stop taking the piss as it's not covered by the warranty. £50 an hour x 20 hours = your warranty total. They're just trying it on because they're expecting the warranty company to cover the bill.
Although at 26k it'd definitely be worth getting onto the other garage.0 -

Thing is it's too late now as they have already took the engine out, how can we fight against their labour costs, if thats what it is ?
We can hardly go elsewhere now as they will charge us to put it back in and then we are back to square one.
I am definately going to puruse the other garage, although I do feel that the warranty company has a responsibility to make sure that the van is in sound condition before issuing a waranty in the first place, and that any works before they issue a warranty should be for them to have to claim back against the previous garage and not us...0 -
Did you give the other garage the opportunity to offer a remedy BEFORE having the other garage begin work?
If not then your not in a great position to be making a claim against the other garage. Even if you did receive a judgement against them I doubt it would cover the whole cost bearing in mind a) they wasn't given the opportunity to sort the problem out b) your paying well over market rates
With regards to the rates with the current garage repairing it.... did you agree to the work to commence? if so, you can't retrospectively decide your not happy with the rates. They may offer you a discount as a 'goodwill' gesture, but thats about it really.0 -
We didn't know what the problem was until the current garage took it in, so we had no opportunity to do this prior to the costs starting to accumulate.
We can't control the rates we are paying by the garage that the warranty company made us go to.
As it stands the bill is currently £600, so yes we could now go to the previous garage and explain the situation which is one of the options we are exploring.

We agreed for them to find out what was wrong, but have told them to go no further at this stage0
