Ok this is gonna sound harsh and totally unfair but im pretty sure that in the case of someone ''pulling out on you'' if they hit the side of your car then its their fault but if you actually run into the side of their car then its your fault (Regardless of the fact they pulled out on you im afraid). Ive been stung with this one a long time ago!
Maybe you're thinking about running in to the back of someone?
If someone pulls out in front of you then it's normally their fault for not paying attention.0 -

Spot on happened to me in feb during the snow, car pulled out of a side street right in front of me ( TBH dont think would have stopped if bone dry) was a very loud bang,made huge dent into wing of other car ( dented my bumper)
anyway told insurance they said its a fault claim and did i want to claim for my car and if i did the 1st 350£ is my excess
