Hi All,
after some great advice on here some weeks ago I've gone a bit claiming crazy and have already fired off 20 claims to various banks etc for mine and family members mis-sold ppi.
I am very lucky that I get a little time at work to do all of this and also an on-site postroom where I can make sure everything gets sent recorded etc (which I of course have to pay for but at least it saves time down the post office!
So far I have had about 5 acknowledgements (from Brclaycard/natwest/hsbc & dorothy perkins). I will put up the Dorothy one soon as i can as they have already rejected and could do with some advice if poss?

Good luck on them all then, fingers crossed and keep at the ones who are rejecting the others.
If you've not been given a final decision, you have the right to ask them to reconsider, if so then give them further information that applies to your account of being mis sold and tell them your not happy to have your case rejected, due to a genuine complaint.

Hi Di, thanks for that. I know I am learning knew things all the time on here and I'd left claiming PPI for so long as I wasn't confident enough to do it. I had done all the bank recharges in 2006/7 for everyone so I thought I'd give this ago! I will type up their response if that's ok?

i write further to your letter we rec'd on 25th oct. I understand your complaint is regarding account cover insurance.
Having checked your acc deatils, I can confirm ACI consisting of price, payment & purchase protection was added on 6th dec 2003, when we rec'd your sigend credit agreement & opened your acc.
I have considered the points set out in your letter and I have detailed below our ersponse to each of the points that you have raised:
I note you say that you were not told the policy was optional when it was taken out in 6 Dec 2003 but I also note that the process that we had in place was to make clear that it was not compulsory. i can confirm that on the agreement you signed it asked you to sign if you required the acc cover which you did. Therefore it appears that it was made clear that the policy was optional and that you elected to take out the insurance. Once a customer has decided to take the product, a policy summary & policy document is mailed to the customer for their review. we also offer a 30 day no-quibble guarantee where the product may be cancelled, and any premiums refunded (subject to no claim being made). This allows time to compare the policy to that of any other insurance companies.
You state in your recent correspondence, that you were given the impression that the card would not be approved unless the insurance was taken out. However, I must advise that it does not state anywhere in the T and C's or in the policy documents that the insurance is a requirement in order to obtain credit and this has never been part of our sales process.
I would advise that full details of all exclusions and benefits have been provided within the insurance documentation. Therefore, if you felt that the insurance policy was not suitable for your personal circumstances we would expect that you contact us directly to cancel the policy upon reviewing the above.
Since you opened your acc, this insurance has been clearly shown on your statements, when a balnce has been outstandind, and could have been cancelled or a claim made at any time.
After a thorough investigation, I can find no evidence of any mis-selling of this insurance, therefore I am unable to refund any of the premiums that have been applied to your acc.
I can confirm that the insurance has now been cancelled on your acc.
This is our final response. We have now reached the end of our internal complaint handling procedures. If you are dissatisfied with our response, you may now refer your complaint to the Finance & Leasing Assoc, using the details provided below:

This seems basic and a letter what most will receive on a rejection.
On one of mine I did not even receive the T&C's until 3 months down the line, and also on another account when trying to cancel they would not allow me to, and yet I would not have been covered anyway as I was then a houseperson.
I would write back and tell them despite what they said, the point is you were told you had to take it out or no loan, and because of this you did not even realise you could cancel, and if you did you assumed you would have to pay back in full as with the ppi being part of the loan.
Tell them you were wrongly sold the PPI, you are a valued customer with a genuine complaint.
Tell them the T&C's is all jargon to you and the staff had a responsibity to make sure the policy would suit all your requirements.
However, I note they were not FSA registered when you taken out the policy, which again they do tend to reject complaints because of this.
The FLA going by some posts on this site, they have not been that helpful, yet one of 2 have succeeded, so it maybe worth then instead of trying the FLA route, if this fails, contact the FOS, even though they will not be able to investigate complaints against a business who were not regulated by the FSA, they may suggest another avenue, for example, the Underwriter/insurer, who would have possibly been regulated.
Its another avenue the FOS have been suggesting as in similar cases to yours.
The lender should provide you with details of the underwriter/insurer on request.
So if you want to try the FLA first, that is up to you, just to rule them out, you can then make the FOS aware you have tried and take it from there with the FOS.
No harm in writing to the bank though and tell them you are disappointed with being rejected and feel they failed you.

This particular one is my Mum's and I would dearly love her to get something back from all of her PPI claims. This account has been in default for some time and she has been paying a reduced amount and also she had a Burton card (which I think might even be ccj'd but will check that out tonight). Not sure what difference the ccj will make on claiming though?

Hi All just an update and a few questions please?
Wrote off to dorothy Perkins again arguing my case and they replied today and still aren't budging from 'no'! So I wills escalate that further.
On a different note, I spoke to my brother today who stupidly has got a claim company chasing a few loans on his behalf ( lloyds). He did this before he knew I was getting my teeth into the ppi business!
So is there any way he can get out of using them now ( he said he's signed something).
They must have requested his statements as they arrived today and clearly show he paid ppi which was 'front loaded' if that's the right term?
now, in nov 02 he took out 5k and paid 1174.85 up front in ppi 'loan advance'.
In may 03 he takes out another 4139.64 and pays another ppi up front of 2212.10.
It looks as though he borrowed another 8k in feb 05 but I can't see any ppi on that statement.
That's as much as they've sent so far so poss more to come. The loans are all paid up now so based on those figures could anyone hazard a guess what he would be owed?

Hi,
as of today 16 of the 21 claims I have submitted have been replied to whether it be not to uphold (1 so far), no PPI on acc (apparently) or just acknowledgements.
But I'm still in fairly early days (first one sent 5th Oct) so I don't expect miracles anytime before January!
