    regardless what the couriers terms are the seller chose ebay and therefore must comply with ebays policies

    i'm not sure I believe the courier doesn't accept claims after 7 days? and if this genuinely was the case then why a retailer would ever use them!

    it could be the cae they require notification of damage in that period
    not the claim as such

    The problem as I see it is the time taken to report the damage, there was no indication at the time of delivery that there was damage and it was over two weeks later before it was reported. Where was the item stored in this time?

    I still think they should use this as a lesson learned and make sure they are available to take delivery of items in future. I know it is hard to take a loss when things are tight but the seller may be strapped for cash too and may just have been selling to help pay off their debts (as is frequently suggested on these boards).

    I do not know how the dispute procedure works with eBay and what are the chances of a successful claim, but can the OP honestly say it is the sellers fault that this was not reported in time so that appropriate action could have been taken.

    The OP has (potentially) the fallback of insurance, whereas the seller just stands to lose out. However, despite mine & dshart's previous mention of insurance, the OP has not indicated they are willing to try this route.

    I am all for consumer rights, but there has to be fairness. Hopefully if an Ebay dispute is raised it will be resolved in the sellers favour, because there is no way in the circumstances that they should be penalised.
