E2 SAVE ''7 day period''

I recently got a contract through E2 save on the Blackberry Bold 9900 on Orange. The phones applications through App world is not working,I informed E2 save within 7 working days.

This is a known problem on the BB 9900 as the operating software that the bold 9900 has problems.

They agreed to change the phone for a new Bold 9900. This arrived yesterday and again the same problem, the applications is actually what I wanted the handset for! As far as im concerned the phone is not fit for purpose.

I do not want to break my contract with Orange. I do not want to be stuck with a phone that is not fit for purpose.

I believe E2 save should provide me with a new phone as I have contacted them within the 7 day exchange period.

WOULD I BE ENTITLED TO A PHONE OF MY CHOICE?

    Generally with most phones, a reset helps but some require the apps to be updated when newer versions are available to download.

    They provided you with a new phone, but you don't like it.
    According to their internal policy on Returns & exchanges you have two options:
    • cancel the agreement (this includes the airtime contract);
    • exchange the handset.
    I don't see why they would object to giving you a handset "of your choice", but as they say: "If the price of the handset exchange is more than the original handset, we will ask you to pay the difference or, where it is less, we will refund the difference". I don't see them selling sim-free handsets, so they may have a different opinion from yours on how much the difference is.
  • Ok i went through to the secondary stage of speaking to a manager at E2 save, Initially after explaining the ongoing problems with the Bold 9900 I was offered only Blackberry only. I explained that I wanted like for like and I wanted the new IPHONE4 i explained i would pay the extra! however after several minutes debating it was apparent E2 save would not give in =, they could offer me a different blackberry and a samsung galaxy s2 however he said it was impossible and there was no structure to offer me the Iphone. I find this difficult to believe, what do you think is the case?

    The iphone is in a different price range to blackberry and samsung phones - so they are probably offering you what is a like for like exchange. Take the Samsung S II if you get that offered though if you are used to qwerty than you may not be too fond of touchscreens. You might get an iphone 3gs - that is in the right price range now.
