Bough faulty item on card and want refund

This is my first post so hi to you all

I bought a car battery from an auto suppliers shop in Peterborough 2 weeks ago
It had 2 year warranty on it and on the recite she had wrote 2 years warranty on it
I paid for it with my Visa Debit card
2 days ago the van wound not start coz the battery was not holding charge
I know it was the battery and nothing ells
On the battery there is a light indicator with a lable of green battery charged, white recharge battery and red replace battery
The red light came on the battery and has stayed on
To me this is clear evidence that the battery is faulty

I rang the shop up and explained why the battery was faulty
I was given all kinds of excesses that is was not the battery and my fault
like if the battery is not charging within 2 weeks then you have something on your van discharging it, I know there is nothing discharging my battery
I insisted it was faulty and I was told to bring it back and they would have to weight till Friday till the man comes in to take them back and test them
They said they would give me a replacement battery in the mean time
I went back to the store with it and again was giving all kinds of excuses why it was my fault
Like your van started up there just fine with the battery on
I then tried to explain the CCA (cold cranking amps) thing but again was giving more bull
I said the evidence is all there the red light is showing and again more excuses like the red light now means nothing
She got a battery from the back to lend to me as a spare, the battery looked use and I said that battery is too small and will never start a heavy diesel engine like mine in a month of Sundays
She went into the back to find a bigger battery
Then it dawned on me that these where all batteries battery that the customers had brought back in to exchange as waste for there new batteries
She got me the right size battery and I fitted it to my van and hay presto flat as a pancake
I took it off went back in the store gave her the old knackered battery and asked for mine back
re fitted that and went round the corner and bough another one from a different shop
i took my 2 week old battery back to the shop ad asked for a refund; she refunded and said it will have to go away for testing
I asked her for a recite that she had my new battery and she wrote on the back 'battery sent away for testing'
I had to ask for her to sing and print

i have a new battery now and have no use for this one
I paid with it on my debit card in the shop and I would like to get my money back is there a was the bank can do this

    I also get customers coming back in claiming batteries are faulty, but we have our own tester on site known as a Battery load tester which helps to identify if there is a fault with the battery. More often than not there isn't a fault with the battery and it does point to being a different problem with the vehicle. Are you sure there isn't a fault with the rest of the electrics on your van?

    Obviously I can't directly advise in your case though as I don't have this battery that was supplied to you.

    What is the green, amber red light thing you mention? I'm not aware of this can you explain please?

    You said near the end of your post, that you asked for a refund and got a refund, so have you got your money back?
    If you have, where is the problem?

    No I did not get a refund
    Some battarys have an indicator light on them or its just maybe one particullar brand
    My other new battery is working fine
    cant understand why they did not have a battery load tester them selfs
    all the scrap yards that sell batterys have one
    I imagine that they will lie about the battery condition being fine

    I doubt the VISA chargeback system would help. It is a voluntary system and you would be more likely to have success if the supplier had ceased trading, for example, but the only way to be sure is to ask your bank and submit a claim.

  • Sounds like the merchant is giving the OP the run around. I don't know much about car batteries, but they are a still a product subject to fitness for purpose terms. The law is no different (though rights are different if you are not trading as a consumer). The OP bought a replacement battery and it works. That suggests to me that the original battery was, indeed, faulty. Perhaps it isn't - but this is civil law. You don't have to prove stuff beyond reasonable doubt. A judge would take the view as to what is most likely.

    More than £100 and S75 is engaged. That would give a remedy against both the CC and the merchant. Less than £100, you are down to the good will of the CC. They might refund if they can cover themselves with a chargeback, but they are under no obligation to help at all. In this situation if they refuse to help you could ask Trading Standards for help or simply sue the firm. From what you have said and their behaviour I feel you have been reasonable and stand a good chance.

    Don't take this the wrong way - your written English isn't really up to scratch. If you do sue (you can start the process online - google "money claim online") I suggest you get a friend to read through what you have written, else unfairly or otherwise you are not giving it your best shot.

    See MSE article re burden of proof. During the first 6 months it is up to the seller to PROVE that no fault exists not up to the buyer to prove that one does exist.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
