thx steve, lessons have been learnt, all was fine untill the ex decided to play with other men and run up debts etc leaving me in the mess. As stated i know the debt is ours but it is in my name her balance transfer to mine. I have sorted out the other debts but the moorcroft one was absolutly shocking how they responded to me particuly when feeling really low and felt like sinking massivly. I have so far paid of about 5K over the last 18 months and feel quite positive about that. Credit rating well not worried about that as that cant be changed and wont be buying anything unless its for cash only. the car i just bought for 1500 i save up for over a few months and worked lots.
My concern is what will happen when moorcroft phone me with threats again about court, baliffs, attachment of earnings.
I will make them an offer in three weeks of 500 or as someone else asked how much to ff the debt and see what they will accept.The word about the scammers is spreading like marmite here in the westcountry.

pleased rest assured they will not send baillifs ok. what you need to do it write to them (never phone) and you need to put in writing of how much you are willing to pay each month and that they have to accept that amount and also ask them to send you some payment slips so you dont have to give them your card details when you pay etc.
Thx raven, how can i write to them and say i am willing to pay £50 a month and that they must accept that. Surely they can refuse that and take legal action?

I take it that having a DMP you have a financial statement with your incomings and outgoings, and what's left over every month. Matter of fact is, if you can't afford to pay £208 then you can't afford it. As long as you're reasonably seen to be trying to pay the debt of no court in the land will find against you. It would just be a case of you going to court showing the magistrate your financial statement. I've got X coming in, Y going out and Z left to pay all my creditors end of. For the amount of debt owed to MC £208pm seems an awful lot to be paying.
I have a friend who works in the debt recovery dept for a bank and when customers default and there seems little hope of getting anything back, your depts are sold on to people like Moorcrofts for as little as 15% of their value.0 -
If all your can afford are token payments at the moment, then that is all you can offer. End of.
Remember, it's a debt collectors job to put "the frightners" on you, and they will do so with all sorts of silly threats if you let them.
They will threaten court action, bankruptcy, home visits, extracting and selling your kidneys, and on and on and on and on.........
The point is that these actions are only very very rarely taken. They are after a "quick buck", and threats are cheap and effective. Actually taking action against people can be lengthy and expensive, so despite their daft threats, they mostly don't follow through.
- Make you offers in writing. Send recorded delivery. That way you have proof in the rare event that it goes to court that you have behaved reasonably, while Moroncroft have not.
- Don't speak to Moroncroft on the phone. It's easier for them to get away with spouting bullwarks on the phone, as there is no proof of what they say, or they can blame it on a rogue member of staff. Forcing them to write means they can't get away with it as easily.

Honestly do not worry about them taing you to court as they wont i can promise you that, they just like to bully you into thinking they will, even in the letter they send they always say MAY not WILL they are !!!!!s As someone said about DCA buy debts for a pence in the pound and try then add large costs and try and recoup some money from the customer. And think about this.....if the orignal creditors could of taken you court for that much...why sell it on to a DCA???!!! Simple answer is becaus it costs too much to take you to court, seriously they wont start any legal action, just threats.Raven. :grinheart:grinheart:grinheart0 -
Please also be aware that for every £10 of debt you owed they have bought that debt for a tiny fraction of that cost....you owe them very little really and more people should be aware of this....your credit rating is the main hit that you face...and in reality should we borrow what we can not afford...?...lessons must be learnt!
Doesnt make sense. They buy the debt because they take the risk of not getting any of it back.

The amount of debt collectors coming out of the woodwork and buying really old debts from over eights years ago is unbelievable and when I tell them its statue barred and I'm not paying they say see you in court.
What an appaling attitude you have. No wonder this country is in so much of a mess if people simply get themselves into debt (probably having a great time while doing so), then ignore said debt until it becomes statue barred, and basically then laugh in the face of those that are grown up enough to face up to their debt.

I know we all have our own points of view, no matter if the debt is Statue Barred, from @1900's
There is always two side of the argument: maybe the debt had been forgotten: maybe the debtor was in a place where they found they could not pay it; maybe the creditor had not applied the proper code to the debt. so many thoughts.
Then, l know l had faced up to my problems of debt, at the end of next year our debts will end on Pay-plan after long seven years. The only way to feel about people problems is to walk in a day in someone shoes, to know how it is to be under pressure of debts and having the choice of paying what we can with out fear and the shame of being in debt etc0
