Employer going into liquidation - Being made redundant

Hi All,

I am very confused right now so come on this site for help.

sorry for the long post but many questions.

I worked with my employer for last 3 years and on sept 26 2011 the company went in liquidation and all the employees are made redundant.
There was no consultation and no notice periods.

So as my employer is insolvent I don't think they will be able to pay redundancy pay any more (they didn't give us Sept pay also). I think there is other method where we can claim from our NI contributions.

I think I can claim the following:
My September pay
Notice pay and
Redundancy pay.

I am right or anything else I need to do?
How long will it take for a claim to be processed if I apply through the NI contributions.

One more thing is I took a new employment on 2nd October 2011 will it effect my redundancy pay as I am already in a new job.

    Well done for getting a new job, I don't believe that has any impact on your entitlement to redundancy pay.

    There is some information on DirectGov here about insolvent employers:

    Insolvent employers

    If your employer is declared insolvent or cannot pay your statutory redundancy pay, you can apply for a direct payment from the National Insurance Fund. To do this you must first write to your employer asking for your statutory redundancy pay. If they are still unable to pay you then you should fill out a RP1 form available from the Insolvency Service.
