ESA Appeal any advice

Ive got my ESA appeal on the 9th Nov,Ive got no representative also no letters from Drs.Does any have any advice of what kind of thing to expect or any general advice.I haven't got a cat in hells chance of passing,as part of my illness I don't leave the house due to panic and anxiety,so I haven't been to my Drs and didn't know how to get a representative.
I made the mistake of dosing myself up on Valium a friend gave me when I had my medical just so I could get through it. I'm past the point of caring now anyway I've been living on £90 a fortnight since Feb and its now been reduced to £73.30 a fortnight. If I fail and go on Jobseekers I hope I`ll get more money as im heavily in debt because of it, its been the worse year of my life.If I end up on Jobseekers there's no way any employer would give me a job,and there's hardly any jobs in my area and not many of them I've got the skills for.Id really love to work again, but I know I'm not mentally ready to due to being attacked at gunpoint a few years ago which caused ptsd.I was fine before this and would love to the same person I was before it happened.
It gets on my nerves all the bloody Daily Heil readers who think its a life of Riley on benefits,I can tell its not you try surviving on less than £40 a week hardly luxury. The people who do manage to live a life of luxury on benefits are usually up to something dodgy to fund their lifestyle.

Not at all, they probably have genuine illnesses and disabilities and receive a range of benefits. There is nothing unusual to get at least £300 a week and all of it is genuine, unlike your usual postings!!

I have a genuine illness and problems but get the sum of £100 pw. I applied for DLA (hoping to get Low Rate Care, £20 pw) and they basically called me a liar, and I was too scared to try again.

Working I could earn double that! The only other benefit my household (FT working parent who I live with) gets is £4 odd a week Council Tax Benefit. I even pay for my medication.

So my life, and the household income would be a whole lot better in more ways than one if I could work.

If I'm not too mistaken, and my memory serves me right, didn't you quote the same incident a while ago? I seem to remember that you said it was in the papers but you wouldn't say which ones.

I have a funny feeling that at the time you had a sister or something and that you had a problem with alcohol and drugs but continued to drive a car? I also seem to recall that reincarnation was your thing.

What happened to the £1/4 million compensation you got?

I wonder if that chappie out of the newspaper had something to do with your previous alias - what was his name - oh yes andycap not forgetting his long suffering wife flo.

    come on try another!!!!

I think your getting mixed up with someone else you sarcastic !!!!!!. I've never mentioned it before I've got no brothers or sisters, haven't got a clue what your on about ??? Typical of MSE come on here for advice and get abuse and sarcasm:mad:

Couldn't read and run (especially due some of the less than charming replies you have gotten). Is there any way you can delay the hearing so you can marshall the facts, speak to your dr, get a representative etc?

Firstly don't worry about monkeymouth, he has been outed as an alias of a troll, and hence is trying to deflect onto other people. He is a ... (insert word as you see fit)! ;)

Could you ask your GP to do a home visit this week? It sounds like you need more medical support than you are currently getting.

If you really cannot get any supporting evidence before the hearing, you need to prepare a submission outlining why you feel the decision was wrong. You should have received details of where you failed the medical/ WCA, you can use these points as headings to explain why the information used by the DWP is wrong, and how you actually do meet the criteria. For instance:

Cannot cope with any change to the extent that day to day life cannot be managed

The DWP stated that I had no problems with coping with change. I disagree with this, I have extreme reactions to any change in my daily routine. I become very anxious and upset, and as such have to be calmed down and rest.
  • ...thought I would open an account and help others.

    Hi RockGypsy

We have just appealed my OH esa decision. The judge and doctor present will have all the paperwork you submitted as well as any paperwork they would have requested from your GP. You can ask your doctors to provide you all the treatment you are currently receiving. You need to gather all the paperwork you have ever had relating to appointments, your medical at ATOS and anything you feel will support your case. The judge and doctor are there to give the judgement on the law and nothing else. They are not there to judge you or make you feel worse.

My mum suffers from agrophobia and requested a delay in her hearing as she too could not face going out. Her doctor provided a letter stating this and a decision was made without her needing to attend and she was put from the WRAG to the support group.

You still have time to advise them of your situation and you MUST!! Call the clerk at your appeal (number will be at the top of your appeal date letter) advising them of the situation. They will advise you what your options are and you can then start to gather all the evidence you need.

I am not going to be critical but you must have been given a date at least 4 weeks before the date so I am a bit confused why you have not gathered this information. Also you stated that you are on £90 a fortnight but the appeal rate for esa is £67.50 a week (unless your under 25).

I know that we dont know your personal situation and I am sure there are other factors but you must must must do this tomorrow as the longer you leave it then worse it will look. There are actions people can take to help you but only you can tell these people what help you need.

I hope you get it sorted.
