... Santander's best course of action in this event would be to claim that the data was omitted from your SAR due to incompetence.

To be fair this would represent a rock solid defence on their part :).

We all know from just reading these posts how incompetence Santy are - can this really be a valid defence ?

Hi,

Sent a complaint letter in February and have just received letter back from Santander.
They're not refunding anything to me so I'll try the toothless F.O.S.
Opened the account in 2002, rates were less than 7%. Now greater than 20%!

Regards,
Will.

I need to find out my interest rates before I complain to FOS. Is SAR the best way to do this? Do I have to request in writing?

You don't need them to complain to FOS. I only had approximate ones. They will get the info they need from Santander.

FOS have worked for me a few times. You had a bad experience with them?

• Right, I emailed my complaint on 24/02/12, and got a letter stating they were looking into it.
Since then, nothing.

I also sent a request for a SAR 45 days ago, again...nothing.

What is my next course of action?

Been there, done all that and got a selection of cheap t-shirts....

Chase up Santy on the complaint via this email address:

ComplaintsChairmans@santander.co.uk

or these numbers :

01908 718 622 / 719 345

Then sit back, relax and wait for your standard rejection letter.

Chase up the SAR with Cahoot directly on :

01274 369 222

If you have requested anything else from your SAR other than Cahoot data you may need to go via the Data Protection team at Santander. For this use the main switchboard initially :

0870 607 6000

With respect to the SAR, I had to threaten* to raise a formal complaint with the ICO before they magically found my request, called me back and promised to send data that day.

This was after four days of no one from any department apparently knowing what I was taking about even though my cheque was cashed two days after receipt.

*I say threat but I had drafted the complaint form and would have been more than happy to despatch it. I still might :)

Good luck.
• I too requested a SAR on 6th march, paid my cheque again had it cashed within two days and sat back to wait for it. Not sure how many days its been (just got home from night shift and cant be bothered to work it out) but anyway it just turned up in this mornings post. The only problem is.....they have sent a SAR for my mortgage account nothing at all to do with my cahoot flexi loan. Now unless i have been giving the wrong account number the whole time on this complaint....and i know i havent..... this just underlines how pathetic santander as a company is at dealing with things! How can they mix account numbers up like that and when the request clearly stated my cahoot flexi loan why did they feel the need to send me pages and pages of statements and mortgage details for two mortgages that are both now paid off as the house got sold last year as part of a divorce. I really cannot believe how bad this whole situation has become that they can make such a stupid error and part of me wonders if it has become confused on purpose....maybe cynical but i dont even know the account numbers for my mortgages as the ex dealt with all that and when you send in a written document asking for facts on one thing and they send you something completely different it does make you wonder. I am about to send another complaint to santander and am expecting them to send the proper documents for no extra fee but am wondering how much success i am gonna get with that! Cant wait to hear the decision from the FOS as i really just wanna wash my hands of santander once and for all. Ironically they also sent a letter about opening a current account with them and that arrived in the same post...........err that will be a no!!!!!

Phone Cahoot on the below and demand that the requested data is delivered in five working days or you will raise a formal complaint with the ICO:

01274 369 222

I you also raise a formal complaint with Santy I would be tempted to ask for your ten quid back as well!

Good luck.
• peeps - I didnt order a SAR, I was going to but then I phoned and asked for details and sure enough I actually got sent a list of all transactions since it opened in 2002 detailing all interest rates, payments in and my withdrawels and balance each time and I didnt have to pay for it. If you want more info than that then perhaps a SAR is best route but it doesnt look like they send you any more than that anyway and youve ended up paying them for the privilege! Im pretty sure I didnt receive all the notices of changes but thats hard to prove...
