Bound into a 12 months contract by mistake!
Grateful for your advice please. On 28th Dec, I upgraded my mobile at a local Carphone Warehouse (CPW) store and I did not know I would be bounded into a new 12 months contract. It is my fault I should have checked before signing the paperwork. Now I would like to change provider as I am not happy with O2 so would like to switch to T-Mobile but CPW are saying I can't do it because I am bound by the contract - see their comment below:-

I can confirm that when you agree to an upgrade you would have agreed to the following below.
"Before I dispatch your new phone I just need to advise you that by agreeing to the upgrade you will be entered into a further 12/18 month agreement. You will be bound to this agreement, and the airtime extension on your account cannot be reversed once I have submitted your order. You can of course exchange the handset on the upgrade within the first 14 days should you have any issues with the handset itself, but you may not terminate the upgrade agreement from this point. Is that OK?"
Once you agreed to these terms and conditions you entered into a verbal contract. If you now decide to cancel your contract you must pay a disconnection fee, which will consist of any outstanding balance on the account, and the remainder of your 12/18 months line rental charges.

I thought we have some form of 30 days cooling off period or something? Is there any way I can get out of this contract?

Looks like you're stuck. Did you think they'd give you a new handset and that you wouldn't be 'tied in'??

Nope...the 14 days was to allow the customer to change his mind wrt the handset. Alas, there is NO cooling off period wrt the contract extension. There would have been a colling off period if the transaction was a new customer signup, however.

it is not fair because I read the papers last night and it's there - minimum 12/18 months contract. not very clear! my fault i know. I also note that they have a right to cancel the contract within the 30 days period but not me!!
