House Boundary

we bought our house 5 years ago, and have the deeds. House came with 2 parking bays round the back. Around the back is run by a management team. Now, we want to put up a shed in one of our bays closest to house. Now management team are saying we are not aloowed too, and that the same rules apply to freeholders, The shed would be within our boundary and does not intervere with neighbours. Before we bought house we was told by sales team that we can put up a garage in one of the bays as long as we can take down when leave. Got intouch with local planning and are awaiting reply. This is stupid as its within our boundary. Please help

    Do you hold the freehold, or do the management company? If you're a leaseholder, I think you have to abide by the decision of the freeholder and can only proceed with their decision.

  • if you thought you owned the space why did you ask the management team for permission ?

    Normally you would own the house and plot up to boundary line and then the parking bays would be for your use but owned by someone else, like a management company, who own and maintain spaces for all your neighbours. It would be included in the deeds like a right of way would.

    What do your deeds actually state ?

    we are a Freeholder, but the Management team have said quote "No, we don’t think you are leasehold, the clause that applies to the leasehold properties also applies to the freehold properties.
    Its within our own boundary

    Some nosey neighbour told management team,as we started to put shed up. where we want to put shed is within our boundary line with space still left over. The management team dont even go into parking bays to clean .where the shed will go is right next to our garden so no-one is encrouched.

    thats an odd one then, if its inside your boundary line the only thing to stop you would be covenants. How pro-active are the management team ? maybe worth putting it up anyway and see what happens ?

    this site is great for your type of dispute, they would probably tell you to download a copy of the land registry to check your boundary line, and title plan which will cost around £8 if i remember rightly.

    we have the map/ deeds, which outlines boundary lines etc, and we are within ours, and causes no problem with our neighbours. I cant see in our deeds where it says that the clauses that applies to Lease holders applies to Freeholders too, as the court yard management team have said.

    If you are sure then I would be tempted to go for it, I have to say though im still not convinced.

    If there are no restrictions as you say then whats to stop you digging up the parking space and puttting a fence around it all ? (should you want to)

    Its hard to picture from your description, do you have a any kind of boundary marker before the parking bays or after them - fence, tree line etc ?

    Yes we have the boundary lines, and its within boundary that sheds going Imagine a ruler, and its the top right side that want put shed.
    If have see solicitor will cost more than shed as its nothing special just wanted more storage.
