I suspect the MIB thing would count if the driver who hit the OPs [brother's] car was also uninsured.
If that driver was uninsured, you'd claim of the MIB.
The MIB would then say "Wait a minute, you were uninsured too, LOL we're not paying you".
This may be because the MIB is funded by a loading on everyone's insurance premiums.0 -

No, I think what Andygb meant, was that because the OP's brother's car was uninsured, the other party's insurer would have the right to refuse to to compensate for the damage caused.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

I’m pretty sure the only people who don’t get paid out in full are ones injured whilst knowingly being carried in an uninsured (stolen?) car.
Certainly, any outsider who suffered a loss would get paid as normal and independent of their own insurance status.0 -

I was just speculating as to the cause of the confusion and what the MIB policy might actually mean.0 -
If you're with Adrian Flux you can't forget to insure, because if you don't notify them any different, they debit your bank account the next year's premium automatically, so you're continuously insured.0

That's one of those ideas that's so brilliantly simple I'm surprised other insurance companies haven't adopted it too.
The only downside I can see is that unscrupulous or incompetent companies would be renewing policies that the policy holder has declined to renew and then taking ages to refund the wrongly taken premiums (and maybe trying to deduct a cancellation fee)0
