12 years ago the situation was the same as it is now.
You do not have to use your own insurer when the damage has been caused by a third party and they accept liability.
(If you only had third party cover 12 years ago your insurer wouldn't have wanted to know!)0 -

Very good of you to accept the fall back for your 'brother'
Bit of a lesson learnt really. Hope it gets fixed up ok. I had a similar incident once (except I was insured) and after tracking down the lorry it all went throguh their insurance no problem.
5t.What if there was no such thing as a rhetorical question?0 -
This thread has just reminded me.... I wonder what happened to the brand new beema that was hit by a bus; did that thread ever get an update?0

How can you 'accidentally' forget to renew you car insurance? You get enough reminders.I used to think that good grammar is important, but now I know that good wine is importanter.0

Your new insurer will not help you claim for an incident that happened before the policy start date.
If the other person has accepted liability you can claim direct from their insurer. Ring them up and tell you want to make a claim against one of their policy holders, they'll tell you what information they require (quotes for repair) to process the claim.0 -
You can claim directly of the other persons insurance, you dont need the insurance company to do it for you. Just get quotes (at least 2) for the repairs and send them to their company.
You may be able to do this, but you would be aiding a crime, because the car which was hit was not insured, and should not have been on a public highway, irrespective of whether it was being used.
As others have pointed out, the only way to keep an uninsured car, is to fill out a SORN declaration and keep it on private land. When you wish to use the car again, or park it on a public road, you have to take out insurance and if applicable tax and MOT the vehicle.0 -

No it is not the same, because the law regarding keeping uninsured vehicles on a road has changed, and the MIB (Motor insurance bureau) stipulate that the owner of an uninsured car, or passengers in an uninsured car cannot make a clain for injury or damage caused to the uninsured car or its occupants.0 -
There are two completely separate issues here,
1) Having a car parked on the road uninsured - better hope the police don't notice
2) Being hit whilst parked - Contact the other guy's insurance directly. They are liable even if your car had no tax, MOT or insurance and was standing on bricks at the side of the road. These days this is the recommended procedure even if you are insured.0 -

start of the thread "my brother has been working away".
Although we should find out who he's insured with. It might stop all the 'Grrrrr my insurance auto-renewed, it must be illegal' threads.0 -
These are my thoughts:
The OP has been dishonest not informing the other party that the car does not have insurance, and therefore the other party has admitted liability, something which would not have happened if he knew the full facts. The police have not been made aware of the full facts by the OP, which is failure to disclose information relevant to the vehicle.
For the rest of us who struggle to tax and insure our vehicles and keep them legal, I hope that this comes back to bite the OP (or his brother?), which I think it will because:
The other party's insurance will run a check on the uninsured car and - bingo! They will not pay out, and will probably inform the police.0
