E bay buyer not happy with item...

hi,i got this for my son at the start of this month (october,2011) & already this product has stoped working & burnt out! when my son put it on yesturday the 24th october 2011 it really smelt of burning so this item is obviously faulty,i would like a new one sent out free of charge or a refund or i will have no choice but to contact ebay customer support & say you have sold me a faulty item which could have caused damage to my home if cought fire or worse harmed my son! if a refund will be made it will have to be payed into my partners paypal account as i no longer use mine,my partners email address is (removed)@hotmail.co.uk

Hi

I'm sorry you had a problem with this item; it was, as you are aware, sealed and BNIB so there's no way I could have known it was faulty. It had been bought for us but never used. I am a private seller, not a business seller and I don't have another to sell so cannot replace it.

While I am happy to do a refund my understanding is that it needs to go to the account the payment was originally paid from. This is because the paypal fees and FVF cannot be refunded if not. Also if I made a payment to a separate account you could claim, at a later time, that I hadn't refunded the payment for this item and there would be no evidence that I had! So it would lead me open to a further claim at a later time.

Please confirm the account you paid from and I will happily refund to that.

Obviously I do know where the payment came from but just wanted to clarify I will refund. This was not an expensive item, sold at 99p. Less than happy about the threatening/think of the children tone.


Am I right in thinking I MUST refund to the account the payment came from to protect myself from further claim?

    [FONT=arial,sans-serif]thanks for getting back to me,the reason why i have asked for my refund to go into my partners paypal account is due to me being at my limit as only have a standard account with paypal & don't trust to join my bank account propley with them as when my sister did this she had all her money taken from her account & if it gets refunded to my paypal account i won't be able to use the money! thank you![/FONT][FONT=arial,sans-serif]

    They can only open a claim from the original account- so stick to your guns. You might even find they have had their account restricted due to a suspicious number of claims- so play a little dumb and just say you will refund the original payment to the original account 'as advised by ebay' on safe return of item. just play th ebroken record 'ebay or paypal have told me I cna only refund the original payment and cannot make a payment to a different account'

    Her problems with paypal are nothing to do with you. You should only refund to the account she paid you with.Otherwise you're absolutely right, she could claim that you'd never refunded her and start a dispute against you. If you think this is in any way dodgy, ask her to return the item before you refund, or at least provide pictures.

    I'm not bothered about having the thing back at all - and I fully realise that her problems with paypal are nothing to do with me anyway.

    So I shall stand my ground;)

    I have looked into making a refund and have to refund to the source account (ie the account the money came from).

    Personally, if you are prepared to refund, I would just hit the refund button now and be done.

    you can click on send money & tipe in my partners email address & put in the amount i need to be refunded for & send it like that & then it would go into my partners paypal account but if you want to refund it into my paypal account thats fine but i just won't be able to touch it as reached my spending limit! thanks anyway!

    I'd still insist on item being returned or photos first- this looks suspicious to me.

    Hi, has feedback been left already??? If it has i would just email, as soon as its returned to myself i wil refund into the account as per payment sent from. Usually its just a ploy and i have also been 'threatened' to refund..... Oh the joys of eb*y!!

    I wouldn't refund until the item is returned, if she opens a dispute she'll be told to return at her own cost.
    Only then refund into the original paypal account.
    She sounds like a chancer.
