In this circumstance I believe the resident can pay the top-up themselves. Otherwise they cannot and it has to be paid for by a 3rd party.
So from what you say, top up fees are not applicable in the situation detailed by the OP as savings are in excess of £23250:My aunt has £40,000 & a house .

Top fees are not applicable when someone has a large amount of money and will be self-funding.Lost my soulmate so life is empty.

So the OP's first post about his Aunt maybe going into a care home - owning a property and having £40K of savings - and needing £15 per week top up fee means he/she has been given incorrect information somewhere along the line....
I'm not being pedantic, just trying to confirm what I said in my reply #9 from my (limited) knowledge - I like to try to make sense when I post.0 -

If your Aunt is self funding , which from the information you have given, she will be ..she will still be eligible for attendance allowance.
Top up fee's do not become an issue unless Adult Social Services are paying towards her care.0 -

And they will only ever be an issue if the local authority are able to provide accomodation which can cater for the persons needs and it is rejected by the family for more expensive accomodation.
The local authority cannot say "our upper limit is £500 per week and you will have to pay top up fees if the home costs more than that" if it is clear there are no homes in the area which can accomodate a person and their needs at the limit imposed by the local authority. If the only home that can cater for a persons needs is £600 a week then the local authority cannot ask for top up fees to be paid.
It is quite simple but social workers work very hard at confusing people and muddying the waters with the intention of reducing costs for the local authority and no other reason."You should know not to believe everything in media & polls by now !"
