Gas Safety Checks

I've looked online and struggled to find who I would report a landlord to for failing to provide a gas safety certificate in a private rented property (no LA involved)

Does anyone know or point me in the right direction.

My old landlord failed to provide one for nearly 6mths and now that we are out of the property we feel that he should be reported as he obviously feels it is appropriate to break the law and not consider his tennants safety.

    What if I break the regulations?

    You are putting lives at risk and breaking the law. HSE gives gas safety a high priority and will take the appropriate action to ensure compliance with the regulations; this could result in a substantial fine and/or a custodial sentence.

    . if they still refuse to provide you with a copy you can make a complaint to your local HSE office.

    your local council is your first port of call - the private rental sector officer.... or their environmental health officer - they will make sure he does not do it again
  • The HSE is the place to get in touch with. Our council pretty much didn't want to know and directed us to them, when our landlord refused to give us a copy of the certificate. We phoned the HSE and had a scanned version emailed from the landlord same day, and a paper copy within the week.

    Really the time to report was when you were living there. How can it matter more once you have moved out than when you were at risk?

    Its HSE you need to report to but don't expect them to treat an complaint about a former LL with a high priority in the same way they would about a current LL.

    In theory, they can prosecute the LL. However, if this is a first report (and from a former T) then I doubt their action will go beyond sending a letter to the LL reminding them of their obligations.

    I too wonder why you were happy to put your life at risk for so long and only now that you've left are doing anything. Fear of LL retribution perhaps?

    I have no idea if the HSE will take seriously a complaint from 'Joe Public' which is all you are now, or not. Worth trying but they may simply say "how do you know a) the property is still rented out and b) there is no certificate now?"

    As an employee of the hated (unjustifiably) HSE, they are unable to take any action if you are not the current tenant. We require a statement from the current tenant to take any action against the landlord. The first step is to try and get the landlord to get the gas checked and provide us & the tenant with a certificate, if this is not forthcoming within 3 weeks then it escalates to enforcement action.
  • He did the check 6mths late, we have both the certificates which show a gap of 6mths so we have evidence,

    GM -We didnt risk our lives, we have relatives who are corgi reg and they did the checks as a favour for us without issuing certificates (at our request). The landlord didnt know this tho and given he broke the law by not providing it there should be some come back on him, even if its just a letter

    It matters because this idiot of a man thought it was ok to shirk his responsibilities, he doenst have a clue about being a landlord, he fell into it as a favour to his son who emigrated and even if he gets his wrist slapped it will be on file so he cant do it again.
