This is only what I have read/been told....

After the letter you should get a phone call within two weeks (though I doubt it will be as quick as that over christmas).

At the phone call they check your address etc, and then after that they send out form ESA50 for you to complete.

You have six weeks to return the form, and then you should be called for assessment within 13 weeks of returning the form - but exactly when during that period is anyone's guess.

If any of the above is wrong, someone should be along soon to correct it, but that is my understanding.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

You have one month to return the form rather than six weeks.

Is that one month from the date on the form? If so, that will be a nightmare as this letter took over a week to get to me!

I'm not surprised that exempt IB'ers are still waiting for an ESA50 to drop through their letterboxes given the current chaotic and apathetic state that exists within the DWP surrounding ESA and the proposed introduction of PIP having to be delayed by at least 2 years from DLA indefinite claimants, also given the increasing number of ESA appeals that are choking up the Tribunals Service due to Atos getting so many wrong and also the chaos surrounding the introduction of Universal Credit this situation is just a car crash waiting to happen.

There will be a return date in the accompanying letter and it's four weeks not a month.

I am on MRC and LRM, it has taken ages. Had a home medical in Jan/Feb and have only received a phone call this morning with the decision that I have been put into the support group. Payments start mid Jan so it has taken almost a year to sort. The lady on the phone said it should have been sorted by April 2012 so they are having to backdate my payments to then.
  • Hi , Ive been medically retired for 13 years from my job and have an Occupational Pension, this pension is paying out £185.00 a month in income tax as i direct result of receiving Incacpacity Benefit , this is 40% of the benefit that i receive this year, its a HMRC !!!! up and i have to pay the money back that i owe from two years ago. So the ESA forms have arrived 3 days before christmas , ive been waiting for this event for 3 years but its come now with the christmas post , nice of them isn't it.
So my question is , im not filling in these forms as in april i get all the Tax back in my pension if i no longer receive any benefits , i don't want there ESA as its means tested and only lasts a year , i will send these forms back blank , but will there be any repercussions because of this , ive been told in the last year that i have a brain tumor and im stressed out as it is and i do not need an extra £200 quid a month from them to make my life any more hell than it already is

When transferring from IB to ESA you will get at least one year of money whatever other money you may have. If in the support group it will be indefinate.
