Is the ticket legal

Options
Hi

I was driving past a camera which is installed on a traffic light. It was green so I just drove past and light flashed. I searched on the internet and found it was a duel purpose camera i.e. traffic light and speeding. Now I went back and could not see any signs of warning motorists of speed camera.

So do I have a case, can I challenge this?

AFAIK, Warning signs are not a requirement.

If you were speeding why would it be wrong for you to be caught and have to pay? Here's a clue, there are little white and red signs next to the road telling you how fast you are allowed to go. Match the number with the little one on your speedometer and you'll be ok.

Never get on your soap box about speeding, everyone I know who's ever done this has ended up being caught out eventually AND they NEVER live it down ;)

Now I went back and could not see any signs of warning motorists of speed camera.

The warning signs (if there is such a rule - I'm not certain) don't have to be in the near vicinity of the camera - in fact I know of one county who have them at the county bourdary saying speed cameras countywide

Lack of speed camera warning signage has never been a bar to prosecution.

Before 2007, signage was required as part of the hypothecation scheme where the SCPs received a portion of the fines they collected.

Now this has ended and all fines go to the treasury.

Was the Notice of Intended Prosecution (NIP) issued to the registered keeper so as to arrive within 14 days of the alleged offence? The date of the offence is day zero.

Some areas don't issue reminders, so the next correspondence in about seven months time would be a summons for the S172 offence. That's a MS90 conviction, 6 points, £350+ fine and costs and victim surcharge. Plus a rather large increase in insurance premiums for the next five years.

That's a big difference to the possible speed awareness course the OP may be offered by responding to the S172 request now.
