unsigned credit card agreement

i went to Nationwide to open credit card but couldn't keep appointment to sign the agreement as son was ill. The next I know I receive a card and pin anyway. I didnt think much of it at the time and started to use the card. I have subsequently lost my job and cant pay the card so was wondering what to do. Help Thanks :eek:

    Pay the minimum payment if you're a bit short.

    What relevance does the unsigned agreement have? Did they force you to spend the money?

    Sounds like a blatant mis-sale and you have every right to get compensation

    And in the unlikely case that the OP takes Andy seriously,here is the smiley that should have followed it... ;)

    Credit agreements are not required to be signed. your son's illness clearly had no impact on your ability to use the card.

    Did you have PPI on the credit card? If so, you could claim on that. Or any other income protection that people take out to cover events like this?

    I am sure the internet will tell you that Jesus is here and that aliens live amongst us. The test cases of nearly two years ago blew the unenforceable credit claims out of the water. Good job too. It would have been a disgrace had it been allowed.

    I refer you to post #4 by Juicy Jesus.

    You signed the card. Used the PIN. Made the purchases.

    So you either agreed to the contract or you've stolen money off them.

    Which is it?

    What you found on the net is at best out of date and may well have not been totally accurate when it was written.

    Pay at least the minimum if at all possible. You could contact them and advise them you're having trouble paying. They may be able to agree a payment plan of smaller amounts, although this would be reflected on your credit report and is unlikely to happen if you've been paying the card fine until now.

    The unsigned document is a red herring. By using the card, you agreed to their terms so a credit agreement does exist between you and Nationwide and you need to honour it.
    This is everybody's fault but mine.
