  • im afraid they can.

they dont need to put it in writing to you, it will be buried in the copious amounts of terms and conditions you probably didnt read on the website.

it is acutally pretty standard, unless you supply all the documents you are not insured, if they request something and you dont supply it, they have you over a barrel im afraid.

typically a letter of no claims is not needed, my newest insurer just asked for my policy number and checked themselves, they did write to me to request it though and gave me 14 days to provide it or lose my insurance and have it re calculated without the no claims discount.

they dont have to provide you with a booklet, as your provider is online all their terms should be readily available to read, they should normally when they arrange your policy inlcude terms on your direct debit letter or in that document, mine was hidden on the back of the credit agreement i had to sign to pay monthly.

driving licence is a no brainer im afraid, you didnt provide it, there is only so far their goodwill will stretch, they have no responsibility to provide you with anything, and when they ask for it, they did give you a deadline and extended it twice.

And, to make matters worse you may now find it more difficult to get insurance because you will now have to answer "Yes" to the question about whether you have ever had insurance cancelled, refused or special terms imposed.

As to your last question, since your insurance was Third Party, Fire and Theft, you wouldn't have been able to make a claim for the damage to your car on your insurance anyway.

my son is insured with e sure and they sent him an e mail to request sight of his driving licence and proof of NCB - which we sent - we then received another e mail requesting the same information
we simply scanned the documents and attached them to an e mail and sent them off

on BOTH occasions they notified us that failure to comply with their terms and condition would result in the cancellation of his policy
they were VERY upfront and clear about this

you were notified and failed to comply - they have prewarned you of the consequences of failing to provide the proof they required so they can hardly be at fault
also - the don't send out policy booklets - they make this quite clear when you buy the policy - that is why their insurance is so cheap - they e mail you a copy in a pdf format - which you should have
    kept.

Also - when your previous insurer sent your renewal notice- it would have shown your NCB - many of them do not send a separate letter now - most insurers use the renewal notice for proof.

I know it is unfortunate, but really, insurance companies will try to wriggle out of any claim if they can - and by not providing them with their required documentation within the specified time they are within their rights to cancel the policy -they had notified you of the fact.

Also - driving licences are dealt with very quickly if you deal with them online - I had to renew my photo id this monthe because it was 10 years old - I did it online (using the photo from my recently renewed passport) on a Thursday afternoon and the licence was with me the following Tuesday morning - in my experience the online DVLA services are extremely efficient.

You could see this as lucky. At least your car was hit by an uninsured driver.

Sorry, i fail to see why i could see this as lucky? The uninsured driver gets away with damaging my car and livelihood as now my partner has lost his job due to not being able to travel to work? I really cant see how I could see this as lucky?

Can I just remind you that your husband was also an uninsured driver, so there's no point getting on your high horse about the other driver. eCar told you the insurance would be cancelled on the 15th if you didn't provide the docs, so he drove the car yesterday knowing that he was uninsured, or at least knowing it was very likely he was uninsured.

Excuse me? This lady was driving knowing that she was uninsured. We did not know that we apparently weren't insured because the insurance company failed to notify us. And if you read my previous email correctly, it turns out the insurance company was lying and we were insured all along, because the police has confirmed this for us. So don't start saying i shouldn't get on my high horse... I suppose you agree with people driving around recklessly without insurance? What a joke!! So can i just remind you.... we were insured all along, it was the insurance company who lied saying we weren't insured and that they had cancelled the policy the day before the stupid woman crashed into my car, which like i have said, the police have confirmed we were in fact insured.

They did not fail to notify you. In your original post you said eCar stated you had until the 15th to provide the docs otherwise your insurance would be cancelled. They notified you, you didn't provide the docs but your husband continued to drive the car knowing (or at least he should have known) that he was uninsured.

The database the police check takes a few days to update, so just because it hadn't been updated when the police looked at it doesn't mean that you were insured.

I don't agree with anyone driving (recklessly or otherwise) while uninsured, which is why I can't summon up much sympathy for you. Your husband drove knowing he was uninsured. How do you justify that? Did you think eCar were just kidding when they said they would cancel it? Your husband drove without insurance, rather ironic that you're now hoping to claim from the MIB (which we all pay for in the long run).
