Overlapping Benefits. ESA(IB) for married couple. Partner's position.

My partner is the main claimant for ESAIB. The couples' rate for this benefit during 13 week assessment phase is £105.95. It seems to me that this consists of £67.50 for my partner and the remainder (£38.45) for me.

If I get Carers Allowance would the £38.45 be taken off the £55.55 thus leaving us £17.10 better off than before?

I mean, would total payable be £105.95 plus £17.50 or would it be £105.95 plus £55.55?

Thanks in advance for any advice.

    No, Carers allowance is an overlappping benefit with ESA, so the CA will not be paid as the ESA results in a higher payment, however, you will be eligible for the Carers Premium which is £31 and will be added to your ESA(IB), bringing the total up to £136.95.

    So if my partner gets into the support group, and also gets DLA Medium Care Component and Lower Mobility Component and I, as her partner, get Underlying Entitlement Carers Allowance would our total benefits be :

    IRESA = £105.95
    Support Group Component = £32.35
    Enhanced Disability Premium = £20.25
    Carers Premium = £31.00
    DLA MCC = £49.30
    DLA LMC = £19.55

    Hi, my hubby is in the support group, he also gets DLA at MRC, HRM and I recieve CA. The figures you have quoted are correct. We just get a bit more mobility than you.

    Our CA ad ESA is worked out slightly differently because I claimed Carer's Allowance (hubby is on my claim as my dependant adult) before the changes to Carer's Allowance last year so I actually get £88 a week CA which is paid directly to me each Monday but they just take it off his money so he receives £102ish a week but it still works out the same as yours will if he gets placed into the support group.

    That isnt correct.

    The CA will be paid because it is the partner receiving it rather than the main claimant.

    The ESA(IR) will be reduced.

    So without Carers Premium you reckon it would be more like this:

    My Partner (Main Claimant)

    ESA = £105.95 minus My Carers Allowance of £55.55 = £50.45
    Support Group Component = £32.35
    Enhanced Disability Premium = £20.25
    DLA MCC = £49.30
    DLA LMC = £19.55

    The carers premium is paid on top of the income related benefit ie. your partner.
  • Still not sure of this. According to the DWP site these are the overlapping benefits that affect CA. It says:

    If you get any of the benefits shown below we may not be able to pay you Carer’s Allowance:
    • State Pension
    • Incapacity Benefit
    • Severe Disablement Allowance
    • a training allowance
    • Unemployability Supplement – paid with Industrial Injuries Disablement Benefit or War Pension
    • Widow’s Pension or Bereavement Allowance
    • Widowed Mother’s Allowance or Widowed Parent’s Allowance
    • War Widow’s or Widower’s Pension
    • Maternity Allowance
    • Industrial Death Benefit
    • contribution-based Jobseeker’s Allowance
    • contribution-based Employment and Support Allowance.
    If we do not pay you Carer’s Allowance because you are getting one of these benefits, you may still be able to get extra money. The extra money may be added to your income-based Jobseeker’s Allowance, Income Support, Employment and Support Allowance, Pension Credit, Housing Benefit or Council Tax Benefit.
    If the amount of benefit you get is less than the amount of Carer’s Allowance you could get, we will pay you the difference.

    If someone is getting any of the benefits shown above, and these include extra money for you, we will arrange for the extra money to stop or reduce. We will then pay the Carer’s Allowance to you.

    My partner is not claiming any of the above benefits, the benefit she does receive that includes extra money for me, are none of the above, but IRESA.

    So does this mean I will get CA full amount and my partner will get an additional carers premium added to her ESA benefits?

    This is confusing me no end. NASA Help please
