Changing taxation class from disabled to PLG - responsibility?

So, briefly -

my dad passed away, we had the car signed over to my mum who will need it sold as it's too big for her, both dimensions & engine size.

My dad was listed as disabled as is my mum, so when the ownership passed, this wasn't a problem.

The chances of the new owner being registered disabled are not impossible, but i would say unlikely.

So the question is, whos responsibility is it to change the taxation class on the V5C (logbook) document from disabled to PLG? Is it us as the seller, or the buyer?

If it's the buyer, i would assume that when a receipt is being written up, that this would also be put on the receipt. Something like

"sold as seen.
buyers responsibility to change taxation class accordingly"?

    Problem with that is the tax disc. On a disabled registered car the tax disk has to be surrendered back to the DVLA if the vehicle is sold no matter if the buyer is going to keep it on a disabled taxation class or not. This means that the new buyer will be driving the car away without road tax.

    Also unless you returned the tax disc that was issued under the DLA certificate for your father and your mother applied for exemption and got a tax disc issued under that certificate number, she has been driving an untaxed car. The tax disc is tied to a specified Exemption certificate and the fact your mother also gets DLA is irrelevant.
  • Thanks Hammyman. I didn't know that. But then i guess that's no excuse in the eyes of the law - everyone should automatically know everything. I'll have to inform her asap.

    I've never had to tax a car without the reminder form before, so i just want to check:

    So we get to sale day & a sale is agreed. The tax disc is taken out ready for posting back to DVLA. How do you (we) go about taxing the car for the new owner?

    In fact it's probably best to get it done now - so how do we go about it without the reminder form?
  • It'll be up to the new owner to change the taxation class.

    I'd also leave the tax up to the new owner too. When I bought a vehicle taxed as disabled I went to a DVLA office, arranged for the logbook to be changed and bought my own tax.

    We did it this way:


    We took the new owner in the car to the nearest DVLA office (ours is nottingham), we were still insured & it displayed the disabled disc we were/are entitled to. So all fully legal.


    She bought a PLG disc at the DVLA office, we surrendered our disabled one.......she drove the car back & dropped us off. We cancelled our insurance upon return.

    Job done. Incidentaly, we did supply the petrol :D

    isnt it up the the new owner to sort out tax not your responsibility just like when you buy any car that tax has run out on

    The problem i see here is this, the tax disc currently on the car is invalid as it was issued to your father who is now deseased, your mother has transfered the car into her name so now needs to tax it using her exemption cert if she is entitled to one, if she isnt entitled to one then she should either send the v5 and the disc back to the DVLA or go to the local DVLA office and get the taxation class changed from disabled to plg and then tax the car accordingly. By sorting it out yourself it will make the car easier to sell.
    Since the current disc in not valid then the car technically should be sorn.
